On May 5, 2022, USDA's Civil Rights Division released the Bostock Memo which updated the complaint processing policy to include protection against discrimination on the basis of gender identity or sexual orientation. This will result in changes to the And Justice for All poster and the long form of the Non-Discrimination Statement. Here are some common questions that the Oregon Department of Education Child Nutrition Programs (ODE CNP) have received.
Question 1: Can I order the new And Justice For All Posters?
Answer: Not yet. USDA has not sent out the new posters to ODE yet. Once it becomes available, ODE CNP will notify Sponsors and will provide instructions on how to order copies.
Question 2: What should I do with the old And Justice for All Posters?
Answer: Keep displaying the old posters until you receive copies of the new ones. If you need additional And Justice For All Posters in the meantime, you can order additional copies of the 2019 version of the posters by contacting your assigned Child Nutrition Specialist.
Question 3: What else do I need to do to stay in compliance with Civil Rights?
Answer: Here are some steps that Sponsors must take right now:

Sponsors must train all staff on how to process civil rights complaints on the basis of gender identity and sexual orientation within 90 days of the memo issuance.
- Sponsors must update all websites using the Non-Discrimination Statement (NDS) long version to the new revised version from the USDA Civil Rights webpage within 90 days of memo issuance.
- All already-printed materials with the previous NDS language must be updated when current supply on hand is exhausted or by September 30, 2023.
Question 4: When will translated versions of the new Non-Discrimination Statement be available?
Answer: The long version of the Non-Discrimination Statement is being translated by USDA but translations are not currently available. Once available, it will be posted on the USDA Non-Discrimination Page.
CACFP Renewals for Fiscal Year 2023 will start on July 1, 2022 this year and will be available until August 15, 2022. Previously, ODE CNP notified CACFP Sponsors of this timeline change in the March 2022 and April 2022 Knowing and Growing Newsletters and in the CACFP Renewal Webinar on May 11, 2022.
Food Program Coordinators and Authorized Representatives will receive the CACFP Renewal Memo in their inboxes in late June 2022.
To get ready for CACFP renewals, we encourage you take the following steps:
- Notify your assigned Child Nutrition Specialist if there has been any changes to the Authorized Representative or Food Program Coordinator role and update your Sponsor Info Sheet in CNPweb for Fiscal Year 2022.
- Take all required CACFP Annual Trainings (see next article - 'Action Required: CACFP Annual Trainings')
- Talk with your administration and team, and collect the information for the Fiscal Year (FY) 2023 operating period of October 1, 2022 through September 2023. Information needed will include: Sites that will be operating and the meal service, months of operation, lead site staff, and more.
- For Sponsors that require a budget: Work with your finance staff to review your FY 2022 budget and update it for FY 2023.
CACFP Center-Based Sponsors are required to complete Annual Training each year. Trainings as assigned must be completed by the Food Program Coordinator and the Authorized Representative in order for Sponsors to be approved for CACFP Renewals.
This information was shared in previous newsletters, but is being shared again as a reminder for Sponsor Staff to take missed trainings and sign up for the upcoming training. Sponsors who do not complete all Annual Training requirements may risk being terminated from the program.
Food Program Coordinators and Authorized Representatives from Center-Based CACFP Sponsors will need to complete all assigned trainings listed in the tables below. Food Program Coordinators who attended the live CACFP Renewal Training on May 11, 2022 do not need to watch the recorded video or take the quiz.

Sponsor staff who are unable to take the live Administrative Oversight training on June 22, 2022 will need to review the recorded webinar and complete a training quiz in order to verify training completion. The recording and quiz will be sent within a week of the live webinar.
USDA is aware that the ongoing infant formula shortage due to supply chain issues, which worsened due to a major formula recall in February 2022, has left many CACFP operators concerned about access to formula and their options for safely feeding infants in their care. Guidance on the infant formula shortage for CACFP operators will be released soon by USDA.
On May 24, the FDA announced that the U.K.’s Kendamil will send three types of routine formula to the U.S. including Classic First Infant Milk Stage 1, Organic First Infant Milk Stage 1, and Goat First Infant Milk Stage 1. These products are expected to land on U.S. store shelves beginning in June. The USDA will provide technical assistance soon regarding the potential allowability of these products in the WIC Program and other nutrition assistance programs. USDA is gathering details/specifications on the product.
Details about the company’s distribution plan are not yet available. Kendamil has set up a website for consumers to receive updates and locate product once it arrives in the U.S. The FDA also has posted a webpage that will be updated with information about additional products headed to the U.S.
In addition, the FDA announced that Abbott will release about 300,000 Cans of EleCare specialty formula on a case-by-case basis. These products were not part of the recall but have been on hold due to the FDA’s investigation at the Sturgis facility. They will undergo enhanced microbiological testing prior to their release.
Parents and caregivers in urgent need of EleCare products should contact their healthcare professionals or Abbott at 1-800-881-0876 for additional information. Abbott will release product immediately free of charge to children in need
Abbott restarted production at the Sturgis facility on June 4 and will prioritize EleCare production, with initial EleCare product release to consumers beginning on or about June 20.

The US Department of Health and Human Services also has a webpage with Information for Families During the Infant Formula Shortage. Sponsors are encouraged to share this information with families who have infants.
On May 20, the J. M. Smucker Company voluntarily recalled select Jif products sold in the U.S. for potential Salmonella contamination. Recalled products were distributed nationwide to retail stores and other outlets. The FDA and CDC are investigating illnesses linked to recalled product. Fourteen illnesses in 12 states have been reported, with two hospitalizations and no deaths.
This is a commercial recall. Due to the number of products being recalled, and peanut butter’s popularity, it is likely that these products have reached many Federal nutrition assistance program participants’ homes through commercial retail channels.
Consumers, including those who participate in USDA programs, who have questions about how to seek reimbursement for their recalled product or how to report adverse reactions should visit www.jif.com/contact-us or call 800-828-9980 Monday through Friday, 8:00 am to 5:00 pm Eastern Time.
This is a commercial recall; USDA Foods are not impacted. The J. M. Smucker Company is a USDA Foods processor. Schools may have diverted USDA Foods raw shelled peanuts to J. M. Smucker for processing into finished products.

Over the last year, ODE CNP has asked Sponsors to share their thoughts and opinions on resources that were needed for CACFP. A large number of responses requested additional guidance on procedures for CACFP. As a result, we are presenting a series of Technical Assistance Webinars with the goal of helping Sponsors write CACFP procedures.
These webinars will be open to all CACFP Sponsors. Each webinar will specify the targeted Sponsor type, but all are welcome.

On June 30, 2022, Dusti Ker will be leaving ODE for exciting new adventures.
For the last four years, Dusti has supported the Community Team as a Program Analyst. In this role, she has worked with all of our CACFP Sponsors by supporting new applicants, CNPweb processing, and even on-site reviews. Dusti has been our cheerful communicator via the ODE Community Nutrition inbox and her kind and patient presence has helped guide many of our CACFP Sponsors.
The ODE CNP team will greatly miss Dusti and cheer her on as she continues to work at her own business while taking time to travel with family this summer. Join us in wishing Dusti all the best in her next chapter!
