House Bill 614 - Good Neighbor Authority
This legislation creates a new chapter in Title 38, entitled “Sustainable Management of National Forests Act” recognizing the many benefits derived from proper forest management of federal forests throughout Idaho. The bill authorizes the Department of Lands to enhance and further implement the existing Good Neighbor Authority program as authorized in 16 U.S.C. Section 2113a (2016) creating accounts in the state treasury for Good Neighbor forest management, and authorizes appropriations from those accounts to carry out provisions of the Good Neighbor policy.

Senate Bill 1219 - State Employees
This legislation establishes a teleworking policy for state employees in executive agencies. In-office employees with positions that do not require direct contact with the public must work at least 75 percent of their scheduled workdays in a two-week period in state offices and meet the requirements of a state telework agreement. In-office employees with job responsibilities that require direct contact with the public are not eligible for telework. Field employees with day-to-day responsibilities outside of the office or in the field are exempt from the telework policy.
This bill also stipulates that any salary increases approved by the Legislature only go into effect as of July 1 in the designated fiscal year, and for the fiscal year 2025; personnel costs cannot be transferred to other categories.
Agencies shall track salary savings and shall use such savings for personnel costs in the same fiscal year as such funds were appropriated or else return such moneys to the general fund. For the purposes of this section, "salary savings" means the difference between an amount appropriated for an agency's personnel budget and the agency's actual personnel costs.

Senate Bill 1243 - Grazing rights, state lands
This legislation would allow the grazing leases from the Owyhee Land Exchange that came in from federal lands to be treated as if it were a federal permit, automatically renewing every 10 years with no auction. It would only apply to lands acquired through federal land exchanges.

This legislation adds a clarifying definition to section 58-1312 in relation to the Lake Protection Act. It defines what the term “modified” means so that the statute can be applied in the way that the legislature originally intended when it amended this section of code in 2006.

Senate Bill 1261 - State Employee Telework
This legislation establishes a teleworking policy for state employees in all three branches of government,including institutions of higher education. On any given day of scheduled work, no more than 15% of in-office employees within an agency, department, or other state office may work outside the office under a telework agreement. This excludes field employees with day-to-day responsibilities outside of the office.

Rules of Practice and Procedure Before the State Board of Land Commissioners
IDAPA 20.01.01 - Pending Rule
IDAPA 20.01.01 protects citizens’ due process rights by governing the practice and procedure in contested cases before the State Board of Land Commissioners and the Idaho Department of Lands.
This rule chapter implements the following statutes: Idaho Code 58-104 State Land Board – Powers and Duties and Idaho Code 67-5206(5)(b) – Promulgation of Rules Implementing Administrative Procedure Act.

The Idaho Department of Lands administers IDAPA 20.03.01, Rules Governing Dredge and Placer Mining Operations under the authority of the Idaho Dredge and Placer Mining Protection Act (Title 47, Chapter 13, Idaho Code).
IDAPA 20.03.01 allows responsible resource extraction while protecting the lands, streams and watercourses of the state.

Rules Governing Administration of the Reclamation Fund
IDAPA 20.03.03 - Pending Fee Rule
The Idaho Department of Lands administers IDAPA 20.03.03, Rules Governing Administration of the Reclamation Fund under the authority of Title 47, Chapter 18, Idaho Code.
IDAPA 20.03.03 provides consistent guidance in how Idaho’s Reclamation Fund (Fund) is implemented. The Fund is a type of state bond pool created in 2002 to provide an alternative form of performance bond or financial assurance as required by Idaho mining regulations. The Fund is to be used by the Department to complete reclamation in the event an operator is unable to so.

IDAPA 20.03.05, Riverbed Mineral Leasing in Idaho establishes a consistent process to authorize mineral exploration and extraction on state-owned navigable rivers and collect rents and royalties.

Rules Pertaining to the Recreational Use of Endowment Land
IDAPA 20.05.01 - Pending Rule (New Chapter)
This is negotiated rulemaking for a new rule chapter: Rules Pertaining to the Recreational Use of Endowment Land (IDAPA 20.05.01).
Senate Bill 1049 was designed to curb the abuse or misuse of endowment land, preserving its revenue-generating potential for the beneficiaries. The legislation, which was signed into law, created a new section of Idaho Code that became effective on July 1, 2023.
The law requires rulemaking to specify prohibited activities that are subject to a warning ticket for minor first offenses, with second violations under the statute being punished with an infraction and $250 fine.

IDL Budget Information
JFAC Appropriations and Fire Suppression Deficiency Warrant Fund
On Tuesday, February 20, JFAC took up IDL's appropriation and the transfer of general funds to the Fire Suppression Deficiency Warrant Fund.
The committee voted 16-3-1 in favor of IDL's $12,447,000 appropriation, sending it to the floor with a Do Pass recommendation. The transfer of $17,000,000 to the Fire Suppression Deficiency Warrant Fund received a Do Pass recommendation with a 19-0-1 vote.

Reports Due to the Legislature
Annual Report
Annually on or before December 1, IDL is required to report to the Land Board concerning the condition, management and financial transactions of the department.
GNA
IDL shall report to the legislature and federal agencies, as appropriate (at least annually) as to the status and performance of any proposed or executive agreements under GNA.
Hazard Pay
IDL shall submit a report to the Division of Financial Management and Legislative Services Office detailing Hazard Pay provided during the previous fiscal year.
Land Exchange
On or before January 15 of each year the Land Board shall submit a report to both houses of the legislature and to the Audit Division of the Legislative Service Office about state endowment lands exchanged and acquired.
Off-Highway Vehicle (OHV) Fund
IDL shall annually publish a report specifically identifying the uses of money allocated pursuant to the subsection.
Over Snow Vehicle (OSV) Fund
IDL shall annually publish a report specifically identifying the uses of money allocated pursuant to the subsection.
Qualifying Contracts
State agencies must report annually to the legislature on all qualifying contracts entered into by the agency the previous year. It must include the following for each contract: the amount, the duration, the parties, and the subject.
Timber License Plates
IDL shall prepare an annual report that is sent to ITD regarding revenues and expenditures associated with funds collected for the special license plate.
