Weekly Update from Supervisor Foley
Dear neighbor:
I thank the residents of Orange County for remaining patient and vigilant during the Airport Fire and supporting our emergency response efforts to protect your health and property. Our partners, including OCFA Chief Brian Fennessey, Sheriff Don Barnes, Governor Gavin Newsom, OC Health Care Agency, OC Fair, City of Rancho Santa Margarita, all of our mutual aide partners, and our entire legislative delegation, worked with us to ensure the availability of vital resources to stop this fire and support impacted residents and animals.
County Local Health Emergency Proclamation
Today, County Health Officer Dr. Regina Chinsio-Kwong declared a local health emergency in the areas of Orange County impacted by the Airport Fire.
The potential for hazardous ash and debris exposure as a result of the wildfire may post adverse health impacts to the public. These include dust particles, runoff, and drinking water supplies including water wells.
We will continue to provide updates to the community as we receive them.

Last Friday night, I enjoyed attending the Dana Point Yacht Club Regatta Charity Sponsor Reception in celebration and philanthropic support of the Boys & Girls Clubs of Capistrano Valley. Thank you to the Boys & Girls Club for creating a safe place to learn and grow while building ongoing relationships with caring, adult professionals, and developing character.
On Sunday, I attended Pacific Marine Mammal Center (PMMC)’s SPLASH event,. The event raised funds for marine life rescue, rehabilitation, and education. My support for PMMC stems from my continued commitment to protecting Orange County’s precious coastline, our diverse coastal ecosystems, and ocean conservation. In addition to saving sea lions and seals, PMMC now also supports beach or tangled whales and whale education. Did you know that the more whales in our local ocean corridor, the less carbon in our area? One whale reduces carbon by 33 tons in its lifetime. Learn more here.
I joined our Laguna Beach/coastal community, including D5 OC Parks Commissioner Hallie Jones, Dr. Alissa Demings & more a the PMMC Splash Event!
I kicked off my Monday morning with the Orange County Transportation Authority Board of Directors meeting in which we discussed new grant funding, the success of our local projec and the future of sand nourishment efforts. I continue to advocate for expedited permitting to deposit more sand on our beaches to protect the rail corridor. The Board approved a $1,000,000 grant from the United States Environmental Protection Agency (EPA) and a $200,000 grant from the California Department of Transportation. These grants will support the OC Connect from Garden Grove to Santa Ana (rails-to-trails) project and our Zero-Emission Bus Transition Plan, respectively. The Board received an update on our Regional Traffic Signal Synchronization Program, an effort funded by Measure M2 tax dollars aimed at coordinating traffic signals across OC jurisdictions. The completed projects in the last year reduced average travel time by 13%. We also discussed preventative action to protect our coastal railways. I continue to advocate for sand instead of boulders, as wide, healthy, sandy beaches protect our rail line and coastal communities. Lastly, the Board approved a letter sent to the United States Army Corps of Engineers (USACE) on behalf of OCTA, urging expedited action and overall clarity on permitting further sand nourishment efforts.
Then, I joined the County Service Center (CSC) in celebrating their milestone five-year anniversary! Did you know that since its inception in 2019, the staff of the County Service Center helped more than 450,000 residents? Congratulations to the CSC on your five years of commitment to excellence in providing a one-stop shop for an array of essential County services. According to County surveys of our customers, 95% of the over 450,000 residents served at our CSC report excellent service. Whether the community seeks answers at our County Information Desk, a copy of a birth or marriage certificate, tax or property deed information, thank you for providing friendly, efficient support.
Then, I attended the American Legion Auxillary Unit 281’s event recognizing eight delegates to California Girls State! American Legion Auxiliary California Girls State promotes the traditions of patriotism and citizenship, in an inclusive and civil environment. Since 1940, ALA California Girls State hosted over 31,000 young women, who become leaders of California and the United States. As a sponsor, I so look forward to watching these young women lead and serve our community!
Monday evening, I joined the Orange County Fire Authority, OC Sheriff’s Department, OC Health Agency, and Chairman Don Wagner for a press conference on the first night of the Airport Fire. I am incredibly grateful for the work of all of the responding agencies and the Emergency Operations Center for acting with urgency to protect our residents.
Our communities must prepare for a rapidly changing environment driven by human-caused climate change, which make wildfires a top threat. The National Oceanic & Atmospheric Administration recorded July 2023 as the hottest month in 174 years. As wildfire seasons escalate, I encourage homeowners to prioritize home hardening to mitigate wildfire threats to our community and qualify you for insurance discounts.
This month also presents an opportunity to pay tribute to Orange County’s first responders. Our Deputy Sheriffs of the OC Sheriffs Department and Firefighters of the OC Fire Authority, as well as our local fire and police agencies. Thank you for risking your lives every single day to keep us safe. The Orange County Board of Supervisors remains committed to providing residents and emergency responders the proper tools to effectively respond to disasters, whether natural or man-made.
I thank Orange County Sheriff’s Department County Emergency Manager Michelle Anderson, Chief Jeff Boyles of the Newport Beach Fire Department, and Battalion Chief Dan Coates of Costa Mesa Fire & Rescue for joining me in raising awareness of the importance of emergency preparedness.
We then recognized Constitution Week, honoring the document that enshrines our freedoms, rights, and liberties. This week, we reflect on how the Constitution continues to stand the test of time – from its signing in 1787 to today.
As the only woman serving on the Orange County Board of Supervisors, the rights granted by the Nineteenth Amendment -- women’s suffrage -- are especially important to me, the women working in my office, and so many other women in public service.
In addition, we recognized National Rehabilitation Awareness Week. This week focuses on raising awareness of the power of medical rehab, providing information on inpatient medical rehabilitation patient outcomes, disseminating useful resources, and reviewing patient journeys to recovery. As the mother of two athletic, active boys, I know all too well the dedication and quality care our County’s physical therapists provide on the road to injury recovery. As the granddaughter of a lively 97-year-old grandmother, I express my gratitude to those rehabilitation professionals who provide her comfort and support as she ages her way. Thank you.
During the Board meeting, we unanimously voted to remove Supervisor Andrew Do from all committee appointments, including the Orange County Transportation Authority, South Coast Air Quality Management District, Orange County Corrections Partnership, Orange County Criminal Justice Coordinating Council, and the Emergency Management Council. I repeated my call for Supervisor Do to immediately resign from the Orange County Board of Supervisors due to his egregious misconduct and betrayal of the public trust. I spoke with both the New York Times and Washington Post who reported on the latest actions taken by the Board of Supervisors.
Later, we took action to appoint current Chief Financial Officer and Acting CEO Michelle Aguirre as Interim County CEO. Michelle is a dedicated leader who has diligently served the County of Orange for 35 years. She has the integrity and expertise to lead this County during this difficult time and has my full confidence and support.
Following the Board meeting, I joined OCFA Division 3 Chief Cheyne Maul and Rancho Santa Margarita Mayor Carol Gamble in the Robinson Ranch neighborhood for an on-site tour and update on the Airport Fire. This was followed by an unexpected Tuesday afternoon press conference that provided the public the latest update on the fire.
What a moving tribute to the lives changed after 9/11. Our way of living transformed. Some of our first responders still suffer from toxic exposure. We must all keep sharing our stories of pain, hope, sadness, loss, and service from that dark time in our nation’s history when 2977 lives were stolen. 8 EMTs, 60 police officers, 343 firefighters died that day. Hundreds more have died since from cancers acquired from breathing the dust during the rescue operation. I never forget them.
Thank you to all of those who sacrificed to save so many.

After this powerful event, I joined Michael Ruane and Alexis Washburn for a Pro-Forma Review with National CORE. With more than 10,000 units and more than 27,000 residents, National CORE’s focus transcends affordable housing – they support families and seniors by providing housing communities that are affordable, safe, and of the highest quality. They enhance neighborhood stability through long-term management and maintenance, as well as industry-leading services such as senior wellness, preschool and afterschool programs, and family financial training.
Next, I attended a tour of the UCI Health construction site. The new UCI Health — Irvine medical campus, under construction at the corner of Jamboree Road and Birch Street, will bring coastal and south Orange County unparalleled expertise, leading-edge treatments and the finest evidence-based care that only an academic health system can offer. The medical campus, which will complement the flagship UCI Medical Center in Orange, will include a seven-story, 144-bed general acute care hospital with a 24-hour emergency department. It also features the Chao Family Comprehensive Cancer Center and Ambulatory Care building and the Joe C. Wen & Family Center for Advanced Care. I love the view of the nature preserve benefiting patients and health care professionals alike.
Then, I got some relief from the heavy issues when I toured Laguna Playhouse Named "Best in OC" in Live Theatre by the OC Register every year since 2015, Laguna Playhouse was founded as a community theatre in 1920, making the Playhouse one of the oldest continuously operating, not-for-profit theatres on the West Coast. Steps away from the Pacific Ocean, Laguna Playhouse is known for its year-round season of captivating comedies, dramas, musicals, stand-up comedy, and family fare. Check out their performances on deck for this season and attend a show.
On Thursday, I toured New Directions for Women in Costa Mesa with Assemblywoman Diane Dixon. New Directions remains committed to providing professional medically supervised accessible wrap-around support services, to assist women and their families in navigating the complexities of treatment. New Directions also hosts an intensive outpatient program offering comprehensive recovery skill development and addiction counseling. Since 1977, more than 5,000 women entered their doors, created in response to a shortage of affordable and accessible recovery programs for women suffering from alcoholism, substance use disorder, and other related issues. They host the only licensed family treatment facility in Orange County.
Then, I joined Orange County Employees Association (OCEA) for their Health Fair! OCEA offered our community free medical screenings, flu shots, and health resources. This Members-Only event is our biggest of the year, supporting our County employees with resources from the OCEA Health & Welfare Trust. Remember, for County employees, OCEA Health & Welfare Trust Benefits Open Enrollment lasts from Sept. 6-20, 2024. If you have questions, please call OCEA at 714-835-3355.
I also attended American Family Housing’s Annual Victory of Spirit Golf Classic reception. American Family Housing celebrates 40 years building and operating affordable housing, with many homes designated for people experiencing homelessness. They are currently partnering with our office, and the cities of Newport Beach and Costa Mesa to convert the Travelodge into apartment units, including homes for veterans. Their collaborative model includes real estate development, supportive services, and property management, because everyone deserves a home they can afford, that is accessible to them and provides them a safe, stable community where they may thrive.
I ended the night at the American Institute of Architects Orange County 70th Anniversary Awards, where our very own Clara Vista Homekey project received a coveted award for its architectural design. Clara Vista is one part of the three permanent supportive housing communities in Stanton that were formerly Motels but now are converted into permanent supportive housing for formerly homeless individuals and veterans.
Before the awards ceremony, famous California Architect and Historian Alan Hess gave a lecture on the history of Orange County's unique architecture. It was a joy to take a trip through the years and see how Orange County's unique charm was showcased in everything from custom homes to the birth of the Master Planned Communities. Most notably, Alan walked through the history of William Pareira, a famed architect who planned UCI and Irvine, and landed on the cover of Time Magazine in 1963 for his vision.

Later tonight, my wife and I plan on bringing our boys to the OC Great Park to attend the fourth annual Mid-Autumn Festival hosted by the City of Irvine and the South Coast Chinese Culture Center from 5:00-9:30 p.m. The Mid-Autumn Moon festival celebrates the fall harvest and full moon, a time when many Asian families (including Vietnamese, Chinese, Taiwanese, Koreans, Japanese, etc.) enjoy each other's company and bountiful harvests after a year of labor and care. Come explore unique cultural displays and discover valuable resources provided by local community organizations. This family-friendly festival will feature educational displays, live entertainment, crafts, specialty food trucks, artistic demonstrations, and more. We hope to see you there. Happy Tết Trung Thu! All week I managed our office’s outreach messaging, so residents stay updated on the Airport Fire. This included collecting information, sending daily updates to our residents via email, and working with our Comms Superstars Olivia and Noah to ensure updates reached our residents via social media, as well. I also continued critical planning for our upcoming Senior Summit at the Ranch Aliso Viejo on Friday, October 4, 2024. I also planned our office’s participation in the OC Pride Parade, which is the next day on October 5. My team also continued planning this year’s Veteran’s of the Year honors, which will be in November.

Hi D5! This week I helped Supervisor Foley write a letter of support for the Talbert Regional Park Habitat Enhancement project with OC Parks. This project will allow OC Parks to build upon previous grant-funded habitat enhancement work including removing invasive species and adding supplemental native seeding. As the former Mayor of Costa Mesa, Supervisor Foley understands the significance of this regional park for the community and remains committed to protecting Orange County’s public open spaces and promoting accessibility for our residents.
Wednesday, I attended the Orange County Fire Authority’s 9/11 Memorial Service. The ceremony included remarks from Fire Chief Brian Fennessy and a ceremonial bellringing by OCFA’s Honor Guard in remembrance of the citizens and first responders who tragically lost their lives 23 years ago.

On Thursday, I attended the San Juan Capistrano State of the City. While there, I enjoyed listening to San Juan Capistrano Mayor Sergio Farias speak about some of the City’s achievements in the past year including breaking ground on a brand new skate park, investing millions of dollars to repave and fix streets throughout the City, and the construction of San Juan Capistrano’s new City Hall in collaboration with Jamboree Housing to build affordable and permanent supportive housing units for its residents.

Monday evening, I accompanied Supervisor Foley to the American Legion Auxiliary Unit 281 California Girl’s State Ceremony. The Supervisor honored eight young women who proudly represented Orange County at the conference – six of whom reside in District 5! As the only woman serving on the OC Board of Supervisors, Supervisor Foley strongly advocates for empowering young women’s involvement in local government. Our office looks forward to seeing this group’s bright future in civic engagement!
On 9/11, I attended the Laguna Beach Fire Department’s Remembrance Day Ceremony and placed flags at the memorial – it was a powerful reminder of the many sacrifices made.
This week reaffirmed District 5’s commitment to promoting local businesses, empowering young women, and supporting our first responders. Cheers to another week of hard work and service!

On Saturday I spent my morning with Olivia at the Ladera Ranch E-Bike Rodeo. Thank you to the OC Sheriffs and California Highway Patrol for teaching us all about the ABC’s of biking: Always check the Air in your tires, your Brakes work properly, and your Chain remains secure. And, of course, wearing helmets is cool, as demonstrated by the professional BMX bikers from BMX Freestyle Team whose backflips and tricks stole the show. Today, I toured of the Orange County Transportation Authority’s upcoming OC Streetcar with our Chief of Staff Nick Anas. These new streetcars will connect our existing bus lines to Metrolink and Amtrak service as well as provide dedicated stops to the bustling businesses of downtown Santa Ana. In 2022 Supervisor Foley provided $1.2 million for 4th street business relief grants for those impacted by the construction of the OC Streetcar. She also worked with OCTA and the City of Santa Ana to approve a construction schedule that would not adversely impact the NOVA Academy Early College Highschool in Downtown Santa Ana.

Last weekend I attended the Summer Pet Adoption Fair in William R. Mason Regional Park, where I interacted with lots of cute dogs and even a couple kittens. There were also K9 demonstrations by the OC Sheriffs and Irvine PD who showcased the dog’s drug and bite training in action. Even through the heat, the event which we cohosted with Councilmembers Tammy Kim and Kathleen Treseder was a great success and lots of the pets got adopted. However, if you missed the event and are still looking to adopt, OC Animal Care has a web page where you can view all the available pets that you can then meet at the OC animal Care Shelter in Tustin. Maybe you’ll meet your new best friend!

On Thursday I attended the Orange County Employees Association Health Fair! Did you know OCEA is the largest independent public-employee labor union in Orange County, representing 18,000 public employees? OCEA works towards maintaining and improving salaries, benefits and working conditions for public employees in Orange County! Members include public health nurses, law enforcement officials, food inspectors, social services workers, and other public servants. I so enjoyed meeting so many OCEA members and learning more about their everyday work keeping our communities safe and healthy.

The Communications Director is responsible for managing the Supervisor’s daily press and digital operations, which includes media outreach as well as preparing press releases, talking points, briefing memos, social media content, and e-mail newsletters.
CAL FIRE Announces Grant for Orange County's Multi-Phased Project to Remove Hazardous Fuels
As part of California Governor Gavin Newsom Administration’s key priorities to bolster the state’s wildfire response and resilience efforts, CAL FIRE has announced $90.8 million in grants for 94 local wildfire prevention projects across California, including for Orange County’s multi-phased project to remove hazardous fuels, including 953 eucalyptus species on interior slopes to safeguard 1,228 single family homes. Congratulations to the City of Newport Beach on receiving $449,763.69 for their “Buck Gully Reserve Hazardous Fuel Thinning and Reduction Project”. The project will reduce vegetation in a 100-foot wide, 1.2-mile long, 14.69-acre buffer area between the rear of residential properties and the adjacent 254-acre Buck Gully Reserve. The Project will bring the area into compliance with local Guidelines and Standards, reduce Greenhouse gas (GHG) emissions due to reduced wildfire frequency and intensity, expand access for fire personnel to the fire perimeter, and create optimal conditions that will make ongoing maintenance feasible. Aside from Buck Gully, vegetation removals are happening throughout Orange County, including Trabuco Creek Habitat Restoration Project at O’Neill Regional Park and routine weed abatement and fuel reduction as part of fire prevention measures, in Orange County Flood Control facilities such as Santiago Creek, El Modena-Irvine Channel, Serrano Creek, and Aliso Creek.
During wildfire season here in Southern California, it remains my priority that we provide Orange County with resources to protect our local neighborhoods and ensure residents receive what they need to support themselves and their loved ones, including their pets. The cost of investing in preventive measures pales in comparison to the cost to respond to the fire, the loss of property and, worse, life. Thank you to CAL FIRE and Governor Newsom for investing in Orange County and our Vegetation Management system.

- Orange County Supervisor Foley Update: Supervisor Foley advised the committee that the county has engaged MGT of American Consulting to conduct a scheduled audit of the County Executive Office/OC Community Resources’ Dana Point Harbor Public‐Private Partnership. The audit will determine if the lessee’s records adequately support the gross receipts reported to the County and that the lessee has complied with the other financial related lease provisions such as accounting methods, payments and annual financial reports. The complete engagement letter outlining the scope of the audit will be posted on the DPHOAC Updates page on the Fifth District web site.
The Supervisor indicated that the DPHP hotel hearing is scheduled with the City of Dana Point to review the EIR, etc., in February of 2025. The Supervisor hoped that the February date could be moved up. In addition, Supervisor Foley reported that construction of the Coffee Importer space at the Ocean Institute is expected to begin in October. Also, meetings are in progress with the DPHP regarding the redesign of the Harbor Patrol area and docks that may also include space, when needed, for a Sheriff’s Department boat that is responsible for the Laguna Beach patrol area.
- County of Orange: CEO Real Estate Update: Christian Gagne, the Dana Point Harbor Oversight Manager for the County of Orange advised the committee that he started working with 5 potential appraisers to undertake the Dana Point Harbor Market Study/Appraisal. The appraiser pool has been narrowed to two primary candidates and once the selection of the primary has been made, they will be given three weeks to onboard themselves with the harbor and the scope of the project and then 90 to 100 days to complete the study.
Mr. Gagne then provided an update on the answers to the list of “Boater Concerns” generated prior to and during the Supervisor’s coffee chat in June. In addition to the questions generated by the Coffee Chat, Mr. Gagne has added additional questions to the list that were submitted by the public as well as from follow up meetings with the Dana Point Harbor Boaters Association. A sample of question topics include; DPHP compliance to the approved development plan with respect to the number of regular slips, ADA requirements, slip size and fire suppression system to name a few. - O.C. Parks Update: Scot Fegley updated the committee on the progress of the OCSEC user interviews being conducted by the IDS Group as part of their space utilization study. He reported that everyone has been contacted with the exception of KG Beach Camp which should be accomplished in the near future. Mr. Fegley also advised the committee that there has been no news with respect to the grant request for the design and rebuild of the OCSEC docks but that communication channels remain open

The OC Health Care Agency reports today that a resident of Huntington Beach has tested positive for West Nile Virus (WNV) infection, becoming the first human WNV case in Orange County this year. Health officials urge residents to take precautions to protect themselves and their family.
“West Nile Virus regularly occurs in Orange County during the summer months and into the fall. With increased WNV Activity reported by our partners at OC Vector Control, we anticipate that additional human cases may be reported in the coming weeks,” said Dr. Matthew Zahn, Deputy County Health Officer. "We encourage everyone to take precautionary measures to avoid mosquito bites as the best way to avoid West Nile Virus infection.” Recommended WNV precautions include:

Emptying all standing water on your property to reduce areas in which mosquitoes may breed, including flowerpots and pet bowls.

Making sure your window and door screens are in good condition.
-
Using insect repellent containing DEET, picaridin, oil of lemon eucalyptus, or products containing IR3535, always following label directions.

Limiting outdoor activity at dawn and dusk when mosquitoes are most active.

Wearing long-sleeved shirts and long pants when outdoors.
Most people who become infected with WNV do not experience symptoms, but about 20% will develop fever and may have headache, body aches, nausea, tiredness and sometimes a skin rash. More serious symptoms, such as severe headaches, neck stiffness, confusion, muscle weakness or paralysis, occur more rarely, but people who develop these symptoms should seek medical care immediately. People over 50 years of age and those with certain medical conditions are at increased risk of serious complications from WNV infection. In 2023 there were 7 reported human infections of WNV reported in Orange County. As of August 2024, an increase in COVID-19 activity and in hospitalizations impacts Orange County. People 65 years of age and older experience highest risk of severe disease. To those 6 months of age and older, stay up to date with COVID-19 vaccinations. If symptomatic, recommendations include preventative measures such as wearing masks in crowded indoor spaces, practicing good hand hygiene, and staying home. Reduce transmission and protect vulnerable populations such as seniors, those younger than one year old, and those with severe medical conditions.

Measles is a highly contagious viral illness. Measles presents with a fever and characteristic rash. Measles can be a serious disease:

This National Preparedness Month, it is important for employees to engage in preparedness actions and become more resilient for disasters. As part of preparedness efforts, two Lunch and Learn sessions will be held to help County employees prepare for disasters.

OC Transit Vision Master Plan Overview & Older Adults Services
E-Bike Update
The Board of Supervisors approved the e-bike ordinance includes common-sense provisions such as grouping restrictions, sidewalk speed limits, helmets for minors, requirements for yielding to pedestrians and equestrians and for an audible alarm when overtaking, consequences for driving without a license when required, and more. While only 8% of the California population, Orange County residents account for 41% of all e-bike accidents in the state. Unsafe e-bike usage remains a growing concern. After our office held numerous community meetings on this issue, our Deputy Sheriffs requested clarity on their ability to enforce traffic violations in unincorporated Orange County. At my request, the Board of Supervisors delivered this clarity just in time to increase safety during the Fourth of July weekend.

Inflation Reduction Act (IRA) Direct Pay’s Role in Uplifting Communities
The Inflation Reduction Act introduced a new era for clean energy development, particularly for tax-exempt and governmental entities. This toolkit is designed to help local government staff and elected officials understand and leverage Direct Pay provisions to enhance community well-being and sustainability.
Understanding Direct Pay: Direct Pay allows eligible entities to receive payments equivalent to tax credits for clean energy projects. This unprecedented move by the federal government is set to catalyze public sector involvement in the clean energy transition.

OC Public Libraries: California State Parks Pass Program
OC Public Libraries is partnering with California State Parks and the California State Library to offer free State Parks vehicle-day use passes, available for circulation at all branches of public libraries in California.
Last year, 9,957 people checked out park passes. Adventure beyond the book allows Californians to access beautiful parks, lakes, beaches, and monuments in the State Parks system for free. Place a hold today!
The goal of the passes is to support parks access equity, removing economic barriers to Californians’ park visits, and that they should be made available to those that need it or may not be using parks already.
