We have taken note of a few COVID-19 updates that have come across the airwaves and wanted to make sure that you are aware of them.
WA Department of Labor & Industries (L&I) Emergency Rule Update
You have likely seen or heard of the WA L&I emergency rule that reinforces employer obligations under the Governor’s COVID proclamations. This is rule making by L&I regarding their authority to take enforcement action on COVID-related workplace safety complaints. Be aware that L&I does have the authority to issue fines to employers. See the L&I website and the highlighted section of the emergency rule document for more information.
Reminder on Washington State Conservation Commission (SCC) Office Visitation

Federal Government Issues COVID Vaccine/Testing Requirements
On November 4, the Occupation Safety and Health Administration (OSHA) released for public inspection an Emergency Temporary Standard (ETS) on Vaccine and Testing Requirements for companies with 100 or more employees. The official version was published to the same website on November 5. You can read more in this MRSC blog, Federal Government Issues COVID Vaccine/Testing Requirements. MRSC states that the requirements do not directly apply to Washington Local Governments, but the State of Washington will notify OSHA if they intend to adopt this ETS, or an ETS that is at least as effective, by November 20.
We are aware this is currently being legally challenged. We will keep our eyes out and alert you if something is published you should be aware of.
WA Department of Health (DOH) Self-testing Guidance for Employers
DOH has published Interim SARS-CoV-2 Self-Testing Guidance for Employers, which provides information to help non-healthcare employers determine the potential use of COVID self-tests for employees and/or develop self-testing policies. Be aware that if you are considering home test, there are regulatory complications. As an employer, if you direct the use of self-testing in any of the ways described in the document, you must receive a CLIA Certificate of Waiver from DOH and report all test results to DOH.
