Division: Division of Occupational Safety and Health (DOSH)

Topic: Emergency (CR-103E) – COVID-19 Prohibited Business Activities and Conditions for Operations

Brief Description: Labor & Industries is responding to the coronavirus disease 2019 (COVID-19) pandemic by filing an updated emergency rule, WAC 296-800-14035, related to prohibited business activities and compliance with conditions for operations under emergency proclamations and their amendments issued under RCW 43.06.220. 

Under the emergency rule:

  • Employers must not allow employees to perform work where a business activity is prohibited by an emergency proclamation.
  • Employers must comply with all conditions for operation required by emergency proclamation.

L&I is monitoring the emergency proclamations, information including guidance from the Center for Disease Control (CDC), and data on COVID-19 and will repeal the emergency rule if no longer needed.

Effective date: October 18, 2021
Expiration date: February 15, 2022

This emergency rule is updated as conditions have changed due to the vaccination requirements under the Governor’s Proclamation 21-14.2 being in effect as of October 18, 2021.

Division: Field Services and Public Safety (Contractor Registration Program)

Topic: Preproposal (CR-101) - Contractor Registration Fee Increase (FY22)

Brief Description: The purpose of this rulemaking is to consider a 5.79% fee increase under WAC 296-200A-900 for L&I’s Contractor Registration program. This is the Office of Financial Management’s maximum allowable fiscal growth factor rate for fiscal year 2022. The Contractor Registration Program registers contractors to ensure that all general and specialty contractors operating in Washington state have appropriate bonding and insurance. RCW 18.27.075 requires L&I to charge a fee for issuing or renewing a certificate of registration and to revise the fee at least once every two years for the purposes of recognizing economic changes as reflected by the fiscal growth factor under chapter 43.135 RCW. A fee increase is needed to ensure the program remains consistent with fee increases as required by statute and to help improve the program’s fund balance.

Topic: Preproposal (CR-101) - Boiler Fee Increase (FY23)

Brief Description: The Board of Boiler Rules and L&I are considering a 5.58% fee increase under WAC 296-104-700 for boiler and pressure vessel inspections and other boiler program public safety activities. This is the Office of Financial Management’s maximum allowable fiscal growth factor rate for fiscal year 2023. The current fee levels are not enough to cover current program expenses. A fee increase is needed to ensure the programs’ revenues match expenditures; otherwise, service levels may need to be reduced.

Division: Field Services and Public Safety (Elevator Program)

Topic: Preproposal (CR-101) – Elevator Rules (Safety Codes)

Brief Description: The purpose of this rulemaking is to consider amending the elevator rules under chapter 296-96 WAC, excluding the rules with fees due to a separate rulemaking in-progress. The elevator rules are reviewed on a regular basis to ensure the rules are consistent with national elevator safety standards and industry practice. The Elevator Program is reviewing the rules to consider adopting new safety codes from the 2019 edition of the American Society of Mechanic Engineers (ASME) A17.1/CSA B44 - 2019, Safety Code for Elevators and Escalators, and other related codes. The 2019 edition of ASME A17.1 would replace the current 2016 code. The Elevator Program is also considering updates, clarification, housekeeping, and other changes to the rules.
