CSMS #52638708 - Clarification - Increased Column 2 Duties on Certain Articles from the Russian Federation
Previously issued CSMS#52458835 dated July 13, 2022, stated effective on or after 12:01 a.m. eastern daylight time on July 27, 2022, specific goods entered for consumption, or withdrawn from warehouse for consumption from the Russian Federation are subject to an increase of Column 2 rate of duty.
CBP clarifies, all commodities that are identified in the attachment (Chapters 1-97 specific), along with 9802.00.40, 9802.00.50, 9802.00.60, 9802.00.80 require a 9903.90.08 classification, along with the underlying classification(s). These entry summaries may require up to three different HTS numbers to be accepted in the Automated Commercial Environment (ACE). Please see the scenarios below:
1. If importer classifies as 8462.25.0010 (FLATTENING MACHINE, MACHINE TOOLS, NUMER CONTR, USED OR REBUIL) only, ACE will require 9903.90.08. The entry summary submission must include two HTS numbers for acceptance.
2. If importer also includes 9802.00.4040 (OTH ARTCLS EXPORT REPAIR/ALTERATION-MADE PURSUANT TO WARANTY) with 8462.25.0010 (FLATTENING MACHINE, MACHINE TOOLS, NUMER CONTR, USED OR REBUIL), ACE will require 9903.90.08. The entry summary submission must include all three HTS numbers for acceptance.
3. However, if importer includes 9817.84.01 (WHEEL BUILDING MACHINES, 84622100-90318000) with 8462.25.0010 (FLATTENING MACHINE, MACHINE TOOLS, NUMER CONTR, USED OR REBUIL), ACE will still require 9903.90.08. The entry summary submission must include all three HTS numbers for acceptance.
Although the increased rate of duty does not apply in scenario 3, ACE will automatically require the submission of all three HTS numbers. ACE will not require an increased rate of duty, as the correct rate will apply.
