2022 Legislative Session's Impact on the MBE, SBR, and VSBE Programs

It's imperative that participating agencies/departments learn about the legislation that passed in the 2022 Maryland Legislative session that will impact the Minority Business Enterprise (MBE), the Small Business Reserve (SBR) and Veteran-Owned Small Business Enterprise (VSBE) Procurement Programs. New legislation will be discussed at the next Senior Procurement Advisory Group (SPAG) meeting; SBR, MBE and VSBE Liaison Training sessions in June and July; and on our Quarterly Compliance Call in June. Check your calendar and plan to attend these events to learn what procurement and compliance policies, guidelines, and forms may be amended or created to comply with the new laws.


Reminder: Procurement Forecast

The FY2023 Procurement Forecast is due on June 30th. The FY2023 Procurement Forecast Instructions and template are located in both the MBE Reporting Toolkit and the SBR Reporting Toolkit. Agencies only need to submit one report with all projected procurements, including SBR designated procurements and those with MBE and VSBE goals.

Keep in mind the forecast is provided to the public and serves as an important tool for the small, minority, women, and veteran business community. Contracting opportunities are vital to the recovery of the small business community.

Procurement Forecasts, which must be provided in EXCEL FORMAT,

Reminder: New SBR/MBE Consolidated Strategic Plan

In an effort to streamline the reporting process, the SBR and MBE Strategic Plans are now being consolidated into one report. What this means is that now each agency will only turn in one strategic plan document. This is similar to the Procurement Forecast process.

The consolidated report will have distinct SBR and MBE sections. For those agencies that participate in both the MBE and SBR Programs, you will make your own determination on the best way to coordinate and compile the information for each section of the consolidated report. For those agencies that are not SBR participating agencies, you will fill out the MBE portion only, and note that you are not a SBR participating agency. 

The FY2023 SBR/MBE Consolidated Strategic Plan is due on or before June 30th.

The strategic plan is a vehicle for agencies to review their progress over time and map out a plan to continue and increase engagement of certified SBR/MBE firms. 

The consolidated Strategic Plan template is now available in the SBR Reporting Toolkit and the MBE Reporting Toolkit.

VSBE Program

VSBE Liaison Directory

The new online VSBE Liaison Directory will go live on the GOSBA website by the end of May 2022. If your agency has not reported a liaison, it will be listed as vacant, just as with the SBR and MBE liaison directories. Check in with Danielle Davis (see contact information below) if you have any questions regarding your agency's listing in this new directory.

 

VSBE Liaison Training - Mark your calendars 

The first VSBE Liaison Training session will be held virtually on Thursday, July 14, 2022 from
9-11:30 am.
VSBE liaisons will receive a calendar invite in the near future. Members of your procurement team are welcome as well.

This session will include an extensive VSBE Program deep dive and a review of the new and improved online VSBE Toolkit. We will also cover updates to the VSBE certification process in eMMA, updates to a variety of the existing VSBE forms, and a review of the new regulations that have impacted the program.

MBE Program

Reporting - FY2022 Quarterly Report

The 3rd Quarter MBE Report was due on April 30th and should contain data from the start of the fiscal year. Quarterly report data is cumulative and serves as a valuable tool for keeping your agency aware of performance throughout the fiscal year and well-positioned to take corrective actions as necessary.

With the 4th quarter underway, remember that liaisons do not submit a 4th quarter report. Instead agencies should work on the MBE Annual Report after the close of the fiscal year.

The MBE Quarterly Report instructions and template are located in the
MBE Reporting Toolkit and should be submitted via email to:
mbereports.gosba@maryland.gov.

Training

The next MBE Liaison Training will occur on June 23, 2022.  Training will include an overview of legislation from the 2022 Maryland General Assembly that impacts the MBE Program. Check your calendar to make sure you have the meeting invite and stay tuned for more information.

The purpose of this conference call is to address issues impacting the SBR, MBE, and VSBE procurement programs in an open and transparent forum.

In addition to your requested topics, we will have an overview of legislation from the 2022 Maryland General Assembly that impacts the MBE, SBR and/or VSBE procurement programs.

Survey Reminder

Agency Liaison Survey

The House Appropriations Committee has mandated a second series of surveys.

  • Similar to the surveys mandated in 2021, our office will be launching the first survey in the series, the 2022 Agency MBE Participation Attainment Survey, at the end of June 2022.

  • Submission of this survey is required and agencies who fail to submit the requested data by the due date will be reported as non-responsive to the Committee. No extension can be granted. More information to come.
