If you are a regular reader of our newsletter, then you likely know that addressing coastal erosion is one of the top priorities for Supervisor Foley. At our Board of Supervisors meeting next Tuesday, the board will vote to allow OC Parks to apply for a grant to design a nature-based solution for erosion at Capistrano Beach. This application will finalize design for a buried cobble berm topped with a vegetated sand dune, which will increase resiliency of the public beach and infrastructure assets by reducing beach erosion and creating dune ecosystems that act as a natural buffer against coastal flooding.
Keep your fingers crossed as we wait to hear back from state agencies on whether they award this competitive funding. Have a great weekend!

Hello, District 5! On Tuesday afternoon, I had the pleasure of attending the Grand Opening of Jack’s Woodside Grill in the vibrant City of Laguna Niguel. Following that, I attended the Ribbon Cutting celebration for Luscious Boutique’s first anniversary in Dana Point. Our offices loves to celebrate the emergence of new businesses in District 5.

This morning, I attended the Laguna Niguel Government and City Affairs meeting, where I had the opportunity to share updates from our office alongside fellow legislative representatives. This month's session featured a presentation by Dr. Kevin C. O’Leary a professor from Chapman University renowned for his expertise in American politics, political theory, and the history of ideas. Dr. O’Leary's presentation centered on the importance of preserving democracy, illuminating the significance of upholding our democratic values for the betterment of our community.

How’s it going, District 5! This week, I attended four ribbon cuttings in my hometown of San Clemente hosted by the San Clemente Chamber of Commerce. We started Thursday afternoon in the wonderful neighborhood of Talega celebrating Kiaan’s Fine Indian Cuisine and CHIP Cookies. Personally, I love desserts, so I highly recommend checking out CHIP. Their cookies are delicious.

Friday morning, I presented certificates on behalf of the Supervisor to both Nai’a Boutique and Twin Flames Candle Bar. Nai’a (also the Hawaiian word for “dolphin”) boasts a beautiful selection of clothing and accessories. Twin Flames Candle Bar offers walk-in and reserved candle-making classes—but also an eclectic assortment of costumes and clothing to peruse while you wait for your candle to finish. During the Chamber’s ceremony, the businessowner, Heide, requested that everyone pick out a hat and sunglasses to wear!

On Tuesday night, I had the honor of presenting certificates to more than 50 distinguished scholars who graduated from high school in Newport Beach, recognizing their outstanding academic achievements throughout their high school journeys. Additionally, I presented awards to three Teachers of the Year, celebrating their dedication and excellence in education. The initiative displayed by these students in enhancing their communities fills me with inspiration, whether it's through leading charity societies and student government or by generously building and donating a 3D printer to a low-income school. Rest assured; we are in more than good hands here in Orange County!

This month, join Tommy Orange (April 7, 2024) and Don Winslow (April 9, 2024) in Costa Mesa’s Norma Hertzog Community Center at 6:30 p.m.
Tommy Orange is the author of the bestselling There There, a multi-generational story about a side of America few of us have ever seen: the lives of urban Native Americans. There There was a finalist for the 2019 Pulitzer Prize and received the 2019 American Book Award. His newest work, Wandering Stars, conjures the ancestors of the family readers fell in love with in There There, asking what is means to be the children and grandchildren of massacre.

Don Winslow has written twenty-one novels, including The Border, The Force, The Kings of Cool, Savages, The Winter of Frankie Machine and the highly acclaimed epics The Power of the Dog and The Cartel. In addition to his novels, Winslow has published numerous short stories in anthologies and magazines such as Esquire and LA Times Magazine. His columns have appeared in Vanity Fair, Vulture, Huffington Post, CNN Online, and other outlets.

This week I focused my efforts on OCTA updates and agendas. Did you know that youth can ride the bus for free and visit all the fun amenities offered here in Orange County. Check out this cool video by our youth council. We are always looking for steps to make the county more cost efficient and offer more public transportation. I also had the opportunity this week to talk to lots of Orange County residents who are struggling with their housing situations. We work hard at the office to help each and every one of you and thank you for your patience. We encourage you to reach out to us if you are residing in D5 and need assistance.

Dana Point Harbor Main Resource Page
Check out the NEW Dana Point Harbor Main Resource web site on Supervisor Foley’s home page located at https://d5.ocgov.com/dph-resources. This comprehensive resource holds all of the pertinent documents concerning the harbor revitalization as well as the minutes from the DPHOAC meetings to date.
Dry Stack Storage Update
Our office and the County of Orange are fully engaged in oversight regarding the operation of the Harbor and appreciate the outreach from concerned community members regarding the Dry Stack Storage.
We are investigating the issue now and will have additional information to report next week. Additionally, Supervisor Foley assigned a County Harbor Oversight Representative Christian Gagne to the project, who can be reached at dphoversight@ocgov.com. Feel free to direct your questions and concerns to him, and he will respond in coordination with our office.

Orange County Community Health Improvement Plan Survey
The OC Health Care Agency’s (HCA) has published the Orange County Community Health Improvement Plan (OC CHIP) Plan update for 2024-26. The draft plan is posted and ready for public review. It will remain posted through Wednesday, April 24, 2024 at 5pm.
The OC CHIP is a vital initiative designed to address the health needs and concerns of our community. It serves as a roadmap for improving health outcomes and ensuring equitable access to healthcare services for all residents. The community’s input was crucial in shaping this plan to reflect the diverse needs and priorities of our community.
HCA uses a comprehensive stakeholder process to develop the OC CHIP. Central to the development and implementation of all programs is the focus on community collaboration, cultural competence, and consumer- and family-driven services. Prioritization of serving the unserved and underserved is a focus, in addition to wellness, recovery, and resilience. Public comments play a pivotal role in the development and implementation of the OC CHIP. By participating in the public comment process, you have the chance to share your insights, experiences, and suggestions for improving community health on the plan written by community members. Your input will help further define our community’s commitment to a healthier Orange County.

E-Bikes
In December, I initiated an E-Bike ordinance at the County of Orange, following a study in coordination with OC Public Works and OCTA. The ordinance will be heard at the OC Traffic Committee this month. Provisions will include restrictions on grouping and taking over streets, strict speed limits on sidewalks , requirements that e-bikes yield to pedestrians and equestrians, requirements for an audible alarm when e-bikes are overtaking a passing pedestrian or equestrians, a prohibition on multiple riders on one e-bikes that are not manufactured for multiple riders, a requirement that e-bike riders yield upon entering a driveway or roadway to all traffic, and other provisions to protect the safety of riders and the public.

During the past several years, Orange County has seen an increase in the number and variety of e-bikes on roads and on paths. Over this time, OCTA has expanded its role to coordinate efforts regionally, monitor e-bike use and trends, and provide safety information to e-bike riders.
OCTA has a webpage dedicated to e-bike resources and safety information, which includes a database listing local bike and e-bike ordinances. To further promote safe and courteous e-bike riding, OCTA is also developing a series of videos about e-bike safety aimed at teen riders. The first video was a partnership with local influencer Goodboy Noah and other videos will be rolled out in the months ahead.
OCTA has also been hosting quarterly e-bike coordination meetings with partner agencies from around the county. These meetings allow the group to exchange ideas and coordinate resources with the goal of keeping people safe and connected in Orange County. At the same time, OCTA is also developing its e-bike safety action plan, which is expected to be finalized by December 2024. This plan will provide recommendations centered around educating the public about safely riding e-bikes and policy approaches to encourage safe e-bike riding.
New Food Pantry in Laguna Niguel!
South County Outreach is proud to announce the opening of their second Food Pantry in Laguna Niguel this March 2024!
The South County Outreach Laguna Niguel pantry is located at 28981 Golden Lantern, Suite D105, Laguna Niguel, CA 92677.
Hours are Monday and Wednesday, 9:00 a.m. to 2:00 p.m.
Clients are able to visit either the Irvine pantry (located on 7 Whatney, Ste. B, Irvine) or the new Laguna Niguel pantry once a month.
Clients must fill out an application, complete a self-declaration of income, and provide the following identification for each household member:
- Provide Identification for all Household Members
- Adults: Government Issued, photo with expiration date
- Minors: Birth certificate, Medical Card, Social Security Card, Passport, OR State ID
- Complete Self-Declaration of Income Form

OCTA Encourages Public to Join Listening Sessions on Coastal Rail Resiliency
OCTA seeks additional public input on a study to find solutions for protecting the rail line and preventing additional emergencies along the coast in San Clemente.
Two public meetings are scheduled – one virtually and the second in person – to gather feedback on the Coastal Rail Resiliency Study and an initial assessment that identified sites along the coastal rail line recommended for monitoring and reinforcement.
The goal is to ensure that rail traffic can continue moving without additional interruptions along this vital rail connection that links San Diego County passenger and freight traffic to Orange County and areas farther north.
The two listening sessions with the public are planned for:

April 11, from 5 to 6:30 p.m., a virtual public meeting via Zoom will be held to get public input

May 30, from 5 to 6:30 p.m., an in-person meeting will be held at San Clemente City Hall, 910 Calle Negocio, San Clemente, CA 92673

The OCTA-led Coastal Rail Resiliency Study aims to evaluate and implement strategies to protect the railway in the vulnerable 7-mile stretch between Dana Point and the San Diego County Line, and keep rail traffic moving through the area for up to the next 30 years, while longer-term solutions are explored.

OC Public Libraries: California State Parks Pass Program
OC Public Libraries is partnering with California State Parks and the California State Library to offer free State Parks vehicle-day use passes, available for circulation at all branches of public libraries in California.
Last year, 9,957 people checked out park passes. Adventure beyond the book allows Californians to access beautiful parks, lakes, beaches, and monuments in the State Parks system for free. Place a hold today!
The goal of the passes is to support parks access equity, removing economic barriers to Californians’ park visits, and that they should be made available to those that need it or may not be using parks already.

UPDATE: Treasury Department opens pre-filing registration for clean energy tax credit
In June of 2023, The Treasury Department announced details of an expanded tax credit for clean energy technologies provided through the Inflation Reduction Act. The feature, known as direct pay by the White House and elective pay by the IRS, applies to twelve tax credits created by the Inflation Reduction Act allowing local governments to receive the tax credit. Among these are a tax credit (direct payment) of up to $40,000 for qualified commercial clean vehicles such as buses, ambulances, and other public fleet vehicles. There is also a tax credit for EV charging infrastructure and clean electricity production such as community solar panels and for clean energy storage.
On December 22, the IRS announced the launch of the IRS Energy Credits Online pre-filing registration tool for taxpayers who wish to receive direct payments or transfer clean energy credits. Any entity eligible for the direct payment must pre-register with the IRS to receive a registration number. The registration number will be required in order to file a tax return and receive the credit.

Orange County officially switched over to a new benefits enrollment portal called BenefitsCal. This new website replaces the former portal, MyBenefitsCalWIN, as a new simple way for our residents to apply for, view and renew benefits for health coverage, food and cash assistance. Households interested in applying for benefits assistance can now create an account at www.BenefitsCal.com and submit their application or link their old MyBenefitsCalWIN case to their account.
