Sometime just before midnight Jan. 27, 1894, burglars broke into the defunct Evening News office in Sacramento and stole over $700 worth of type and typeset equipment. Why is this part of Placer County history? Because the stolen goods ended up in the office of the Placer Argus newspaper in Auburn the very next day.
When news of the burglary was published in the Jan. 29 Evening Bee, Placer County Sheriff Conroy became suspicious. He noted that Fred Stuart and Charles Goldsmith of the Placer Argus had left in a wagon the morning of the 27th and returned the afternoon of the 28th.
After an initial round of questioning, both men said they had gone to Lincoln, not Sacramento. But Sheriff Conroy questioned Stuart separately, confiding that he had proof the men went to Sacramento, and Stuart confessed to the trip. He said he was told to say they went to Lincoln. The stolen equipment was returned to Sacramento.
In the months that followed, various legal arguments produced two trials in which Stuart was tried first for stealing the type equipment while three other men (Goldsmith, Thomas Fitzsimmons and W.W. Rodehaver, all of the Placer Argus) would be tried next.
While deliberating, the jury in the Stuart trial asked the judge if Stuart was involved in a conspiracy with Goldsmith. The judge said it was for them to decide, and the jury promptly acquitted Stuart. Because the same testimony would be introduced in the second trial, the case against the other conspirators was dismissed.
