Notice of Intent to Adopt Rules
The Wyoming Environmental Quality Council (EQC) will consider proposed revisions to the Wyoming Department of Environmental Quality, Land Quality Division (LQD) Noncoal Rules Chapters 2 – Regular Noncoal Mine Permit Applications, 9 – Permit Application Requirements for Small Mining Operations, 10 – Limited Mining Operations for Fifteen Acres or Less of Affected Land, and new Noncoal Chapter 14 – Blasting for Noncoal Surface Mining Operations at a public hearing to be held at 10:00 a.m. (MST) on June 23, 2026. Individuals interested in attending remotely or wish to use a digital presentation may contact Joe Girardin at (307) 777-7170 or joe.girardin@wyo.gov at least three days prior to the hearing.
The proposed revisions to LQD Noncoal Chapters 2, 9, 10 and new Noncoal Chapter 14, Docket #26-4101, were written in response to 2024 WY House Bill 0033 which required the LQD to draft and recommend rules governing the use of explosives at new and existing noncoal surface mining operations for promulgation by the EQC.
The proposed rules in Docket # 26-4101 meet the minimum substantive state statutory requirements per Wyoming Statute § 16-3-103(a)(i)(G).
