Public Notice: Coal Mine Permit Revision Application - Thunder Basin Coal Company LLC, PT0233, TFN 7 5/164

The Thunder Basin Coal Company of Wright, WY has applied for a revision of its coal mining permit Black Thunder Mine Permit No. 233, approved December 3, 1974, from the Land Quality Divis ion of the Environmental Quality Department for the State of Wyoming. The mining permit area is located in: all of Sections 2, 3, 4, 5, 6 and 11; W/2W/2 of Section 1; E/2 of Section 10; S/2SW/4 of Section 12; N/2SW/4, NW/4, W/2SW/4NE/4 of Section 13; NE/4, NW/4, N/2SE/4, N/2SW/4 of Section 14; NE/4, N/2SE/4 of Section 15; all in T42N-R70W. All of Sections 1 and 2; N/2NE/4 SE/4NE/4 of Section 3 all in T42N-R71W. SW/4SW/4 of Section 6; NW/4, portions of SW/4 of Section 7; all in T43N-R69W. All of Sections 2 – 36; W/2, SE/4, S/2NE/4, NW/4NE/4 of Section 1; all in T43N-R70W. All of Sections 1, 2, 8 – 17, 19 – 27 and 34 – 36; E/2, SW/4, S/2NW/4 of Section 3; S/2 of Section 18; and E/2 of Section 28 all in T43N-R71W. All of Sections 19 – 20, 27 – 30, and 31 – 35; S/2 of Section 21; S/2 of Section 22; W/2SW/4 of Section 23; SW/4SE/4, SW/4 of Section 25; S/2, S/2NE/4, S/2NW/4, NW/4NW/4 of Section 26; W/2, W/2NE/4, W/2SE/4 of Section 36; all in T44N-R70W. All of Sections 14, 23 – 26, 35 – 36; SE/4 of Section 22; S/2 of Section 13; E/2 of Section 27; E/2 of Section 34; all in T44N-R71W of Campbell County, Wyoming. Black Thunder Mine is approximately 12 miles southeast of Wright Wyoming and has a physical address of 4669 Hwy 450, Wright, WY 82732. This area can be found on the Reno Junction, Hilight, Open A Ranch, Piney Canyon NW, Reno Reservoir, Little Thunder Reservoir, Teckla SW, Teckla, Piney Canyon SW USGS quadrangle maps. The mining operation began December 1974 and is estimated to continue until 2045. The land, after mining, will be returned to wildlife habitat and agricultural production in the form of grazing. This revision modifies the post-mining topography.

Information regarding this application may be reviewed in the Office of the Land Quality Division, Department of Environmental Quality in Cheyenne and Sheridan, Wyoming or the Campbell County Clerk's Office in Gillette, Wyoming. A complete index sheet identifying all proposed changes is located with the revision application material available for public viewing. Written objections to the revision must be received by the Administrator of the Land Quality Division, Department of Environmental Quality, 200 W. 17th Street, Suite 10, Cheyenne, WY 82002 before the close of business May 30, 2024. Objections may also be submitted by the same deadline via the Land Quality Divisions electronic comment portal at https://lq.wyomingdeq.commentinput.com. Only the revision is open for public review. The Director shall render a decision on the application within thirty (30) days after the deadline to file objections if no informal conference is requested. An informal conference shall be held within thirty (30) days after the final date for filing objections unless a different period is stipulated to by the parties. The Director shall publish notice of the time, date, and location of the conference in a newspaper of general circulation in the locality of the proposed operation once a week for two (2) consecutive weeks immediately prior to the conference. If the Director holds an informal conference, all parties to the conference shall be furnished with a copy of the final written decision of the Director issuing or denying the permit within sixty (60) days of the conference. The applicant or objector may appeal the Director's written decision after an informal conference to the Council. If a hearing is held the hearing would be conducted as a contested case in accordance with the Wyoming Administrative Procedure Act (W.S. §16-3-101 through §16-3-115) with a right of judicial review afforded as provided in that act and W.S 35-11-406(p)(iv). The Wyoming Oil and Gas Conservation Commission will be mailed a copy of the application mine plan map as required in W.S. §35-11- 406(j).
