As we head into what are typically the warmest months of the year, it's important to be aware that migrant seasonal farm workers in Wisconsin have additional health and safety protections, including heat protections, under revised administrative rules.
These protections for workers, that took effect Feb. 1, 2024, include the development of a heat illness prevention plan. The prevention plan must, among other requirements, allow for shade and breaks when temperatures exceed 80 degrees. The plan also must include additional procedures when temperatures exceed 95 degrees, such as ensuring workers are aware of their right to take breaks, and empowering workers to call for emergency service when necessary.
Revisions that promote health and safety in migrant labor camps include updated requirements for urinals and showerheads, improved access to washers and dryers.
Certain changes that require physical modifications to the workplace do not take effect immediately. Additionally, affected employers, migrant labor contractors, and agents of employers have an opportunity to request a variance from certain requirements.
