What reasonable accommodation can I expect from my employer if I have a doctor's note?

Wisconsin Fair Employment Law protects people with disabilities by requiring employers to allow reasonable accommodations in the workplace that make it possible for employees with disabilities to continue working. If you have a disability and are seeking a reasonable accommodation, it may take more than a doctor's note to support your request. 

Take steps to declare your disability

To request an accommodation, you must first tell your employer about your disability and ask for a specific accommodation. A doctor's note does not require your employer to grant you a permanent or even temporary medical restriction and does not guarantee you time off. To declare your disability and request an accommodation, you must tell your employer that your impairment or condition:

• is chronic or permanent
• interferes with your ability to perform the essential functions of your job
• can be accommodated in particular ways that will allow you to do satisfactory work

Be prepared to verify your condition 

If you request an accommodation, your employer is obligated to engage in the interactive process which is a conversation to determine an appropriate accommodation. You are not obligated by law to give your employer access to your medical records, but your employer is entitled to know what your disability is and what your medical provider lists as your limitations and suggested accommodations.

Know Your Rights

If you have a disability, it is important to understand that you have the right to equal opportunities in hiring, training, promotion, and compensation as differently abled employees. You also have the right to declare to disability and ask for reasonable accommodation. If you believe that you have experienced unlawful discrimination on the job because of your disability, you may benefit from contacting the Wisconsin Department of Workforce Development Equal Rights Division.
