Student Discipline Rulemaking Update 

Following the passage of 4SHB 1541, OSPI completed expedited rulemaking to align Chapter 392-400 WAC with the new provisions of the law before the 2016–17 school year began. However, the agency also recognized the need to do additional rulemaking—as mentioned in OSPI Bulletin 024-16, which was disseminated in early June. On November 1, 2016 the agency filed a CR 101 Preproposal Statement of Inquiry to initiate regular rulemaking on Chapter 392-400 WAC.

 

As part of the plan for implementing 4SHB 1541, OSPI decided to reconvene the discipline task force, established under RCW 28A.600.490, to review and recommend data collection standards related to Part I of 4SHB 1541. The task force is also working towards providing recommendations to inform the rulemaking process. Information about the organizations represented on the task force, upcoming meeting details, and materials from past meetings can be found through the Student Discipline Task Force webpage.

 

While the rulemaking process timeline is dependent on several variables, the agency expects proposed rules will be filed during the month of February, to be followed by a public comment period, and the tentative publication of final rules to occur in April, 2017. The public comment period will be open for anyone to submit comment, either in writing or in person at a public hearing that will be announced and held during this time.
