On November 10, 2021, during a regularly scheduled meeting, the Liquor and Cannabis Board took the following actions on these Board Interim Policies (BIP):
Liquor Policy Rescinded (Withdrawn):
Rescinded Board Interim Policy 01-07 about guidelines for determining that an area is “adequately served” under RCW 66.24.420(5). This policy provided guidance to local governments and liquor license applicants regarding the type of information that would help the Board determine if the spirits, beer, and wine restaurant licenses granted for a particular locality were “adequate” for the reasonable needs of a community. However, Substitute Senate Bill (SSB) 5367 (Chapter 271, Laws of 2009), codified as RCW 66.24.600 established the spirits, beer and wine nightclub license, and added a license type that could be considered when determining whether there were adequate licenses in a locality to serve the reasonable needs of a community, and this BIP is no longer necessary.
Marijuana (Cannabis) Policy Rescinded (Withdrawn)
Rescinded Board Interim Policy 11-2019 regarding laboratory certification and accreditation requirements (WAC 314-55-0995). This BIP provided certified cannabis testing labs with the ability to pay all vendor fees for validation and ongoing monitoring directly to the WSLCB or its vendor. BIP 11-2019 was issued because WAC 314-55-0995(3)(c) provides that the Washington State Liquor and Cannabis Board (WSLCB) may contract with a vendor to conduct the validation and ongoing monitoring, and the certified lab must pay all vendor fees for validation and ongoing monitoring directly to the WSLCB’s vendor. The agency has reviewed the existing BIP, and determined that converting it to a policy statement is appropriate as a placeholder until rulemaking occurs.
