Today the WSLCB Board held a special Board meeting authorized under the Governor’s Proclamation 20-28. During the Board’s meeting they considered and authorized the withdrawal of one proposed rule, and adopted five emergency rules, all listed here:

Cannabis-related Board actions:

Board Withdrawal of CR 102 for QC Testing – The Board withdrew its proposed rulemaking related to quality assurance sample testing.

Emergency rule (CR103E) regarding WAC 314-55-092 : Allows LCB to waive fees and penalties required for marijuana licensees who were or are late paying their monthly excise taxes. The period of time covered by this rule is retroactive and covers from February 29, 2020 until the Governor’s proclamation is lifted or until the Board rescinds the rule – whichever happens first. (Approved, March 27, 2020)

Alcohol-related Board actions:

Emergency rule (CR103E) regarding WAC 314-02-109 – For Spirits Retail Licensees Quarterly Reporting and Payment Requirements, the LCB may waive fees and penalties required for these licensees who were or are late reporting or paying their quarterly taxes. The period of time covered by this rule is retroactive and covers from February 29, 2020 until the Governor’s proclamation is lifted or until the Board rescinds the rule – whichever happens first. (Approved, March 27, 2020)

Emergency rule (CR103E) regarding WAC 314-19-020 – For microbreweries, domestic breweries, and beer distributors or wineries and wine distributors, the LCB may waive fees and penalties required for these licensees who were or are late reporting or paying their quarterly taxes. The period of time covered by this rule is retroactive and covers from February 29, 2020 until the Governor’s proclamation is lifted or until the Board rescinds the rule – whichever happens first. (Approved, March 27, 2020)

Emergency rule (CR103E) regarding WAC 314-28-080 – For Distillery licensees, the LCB may waive fees and penalties required for these licensees who were or are late reporting or paying their taxes. The period of time covered by this rule is retroactive and covers from February 29, 2020 until the Governor’s proclamation is lifted or until the Board rescinds the rule – whichever happens first. (Approved, March 27, 2020

Emergency rule (CR103E) regarding WAC 314-23-022 – For Spirits Distributor licensees the LCB may waive fees and penalties required for these licensees who were or are late reporting or paying their taxes. The period of time covered by this rule is retroactive and covers from February 29, 2020 until the Governor’s proclamation is lifted or until the Board rescinds the rule – whichever happens first.(Approved, March 27, 2020)

The Governor’s Proclamation 20-28 authorizes the Board to meet and take action without adhering to mandated processes for public meetings for routine matters or matters necessary to respond to the COVID-19 emergency. We’re looking for alternative ways we can engage with you during these challenging times.
