KENMORE, Wash. – On July 25, 2023, HM Pacific Northwest, Inc. (formerly known as Cadman Material, Inc.) filed a motion with the Pollution Control Hearings Board (Board) requesting that its appeal of Puget Sound Clean Air Agency’s (PSCAA) October 26, 2023, Order of Approval for NC No. 11861 be dismissed. On August 21, 2023, the Board granted HM Pacific’s motion, and dismissed the appeal.
PSCAA issued Order of Approval No 11861 on October 26,2022 (Order of Approval), which established emission limits, operating requirements, and odor monitoring conditions on operations of HM Pacific’s asphalt plant in Kenmore (Facility). With the dismissal of the Board appeal, all of the conditions of the Order of Approval remain in effect. Also, on May 8, 2023, PSCAA issued Notice of Violation # 3-A000845 to HM Pacific related to emissions testing at the Facility. Prior testing at the Facility required by the Order of Approval did not demonstrate that the Facility met emission limits in the Order of Approval and the Facility has not been operational pending PSCAA review of retesting that occurred on August 15, 2023. PSCAA, which has jurisdiction over its notices of violations, had its representatives present at the retesting. PSCAA’s review of this second test is expected to be complete within 120 days of the testing, after which it will work with HM Pacific on resolving Notice of Violation # 3-A000845. As of this writing, the HM Pacific Facility in Kenmore is in idle status.
