On January 14, we sent a message about changes to PFML requirements for maintaining health benefits.
We provided incorrect contact information for ESD in that message and the associated PFML FAQ document (which has been updated). We apologize for the inconvenience. If benefit administrators have questions regarding what health benefits must be maintained under PFML, the correct contact information for Jason Barrett at ESD is jason.barrett@esd.wa.gov or (360) 485-5003.

A corrected message appears below:
Effective January 1, 2026, there will no longer be a requirement for PFML to run concurrently or have overlap with FMLA to maintain health benefits coverage. Health benefits are to be continued during the duration of the approved PFML per RCW 50A.35.020.
Previously, the employer contribution toward maintaining health benefits required at least one day of overlap with FMLA.
Please note that even though PFML addresses maintenance of health benefits, HCA is not the administering authority over PFML. The legislature gave ESD sole authority over the PFML program.
