Effective January 1, 2026, there will no longer be a requirement for PFML to run concurrently or have overlap with FMLA to maintain health benefits coverage. Health benefits are to be continued during the duration of the approved PFML per RCW 50A.35.020.
Previously, the employer contribution toward maintaining health benefits required at least one day of overlap with FMLA.
Please note that even though PFML addresses maintenance of health benefits, HCA is not the administering authority over PFML. The legislature gave ESD sole authority over the PFML program.
If you any questions about what health benefits must be maintained under PFML, please contact Jason Barrett at ESD at barrett@esd.wa.gov or 360-764-4171.
We have also created a Paid Family Medical Leave FAQ document to address some of the questions you may have.
