Liquor and Cannabis Board:
Section 65 requires the Board to begin accepting applications for the manufacturer license and the testing laboratory license beginning November 1, 2027. Fees for the licenses are to be deposited to the psychedelic substance manufacture and testing control and regulation account created in section 79 of the bill.
Section 71 establishes the manufacturer license. Licensure fees established in rule may not exceed, together with other fees collected under this chapter, the cost of administering this chapter. There would be no cash receipt impact until fiscal year 2028 when the Board begins accepting applications for the license. The Board is estimating that 1,250 manufacturer licenses will be issued. No assumption has been made about what fee amount the Board would impose for the license. With that said, the estimated annual average cost to administrate the manufacturer license for fiscal year 2028 through fiscal year 2031 is $3,805,257. If it is assumed the annual fee for license issuance and renewal is set at an amount to offset costs then the fee amount would be $3,044 per license ($3,805,257/1,250 licenses).
Section 92 creates the testing laboratory license. Fees adopted in rule under this section must be reasonably calculated to pay the expenses incurred by the board under this chapter. There would be no cash receipt impact until fiscal year 2028 when the Board begins accepting applications for the license. A very small number of applications is anticipated for the laboratory license. Therefore, costs are expected to be minimal related to the testing laboratory license. No assumption has been made about what fee amount the Board would impose for the license.
Section 95 allows the Board by rule to require a licensee to submit a label or packaging intended for use on a psychedelic substance product for preapproval by the Board before the licensee may sell or transfer a psychedelic substance bearing the label or packaging. The Board may impose a fee for submitting a label or packaging for preapproval under this section that is reasonably calculated to not exceed the cost of administering this section. Fees are to be deposited to the psychedelic substance manufacture and testing control and regulation account created in section 79 of the bill. The cost to administer this section is $233,718 annually. No assumption has been made as to how many requests for approval of psychedelic substance labels or packaging would be received, or what fee amount, if any, the Board would impose for doing so.
