SB 5660, titled AN ACT Relating to access to psilocybin services by individuals 21 years of age and older, has been introduced in the Senate. The Office of Financial Management has identified this bill as requiring a ten-year projection of increased cost to the taxpayers or affected fee payers.

Department of Health:

Sections 13, 23-25, 26-29, 30-40, 41, 66, 97: Due to the lack of reliable data to support assumptions for the number of licensees the department may expect under this chapter, the cash receipts impact for license applications and renewals is INDETERMINATE. 

 

Section 24: The department must adopt rules that designate different types of manufacturing activities, including the creation of a microtiter manufacturing endorsement with license fees which are lower than the regular manufacturer license fees to reduce barriers to access. Microtier manufacturing activities will be determined during rulemaking starting in fiscal year (FY) 2023. Due to the lack of reliable data to support assumptions on the volume of microtier endorsement applications the department may expect under this chapter the cash receipts impact of these sections is INDETERMINATE. 

 

Sections 106 & 108: The department may require a licensee to submit psilocybin product labels and packaging for preapproval and may impose a fee for submitting a label or packaging for preapproval. The bill requires this fee be reasonably calculated to not exceed the cost of administering this section. Fees will be established during rulemaking starting in fiscal year (FY) 2023. Due to the lack of reliable data to support assumptions on the volume of licensees the department may expect under this chapter and the resulting volume of labels and packaging which may require preapproval, the cash receipts impact of these sections is INDETERMINATE.  

 

Sections 75, 103, &112: The department may impose a civil penalty between $500 and $5,000 for each violation of a provision of this chapter or rule adopted under this chapter. Since licensees can appeal fines assessed, it is assumed that any penalties will be appealed. Therefore, the amount of revenue collected from the fines is unknown, and this component of cash receipts is INDETERMINATE.

 

Washington State Patrol:

The proposed legislation creates access to psilocybin services for individuals 21 years of age or older in Washington state.

 

Sections 16, 67, and 98 states that the Department of Health (DOH) may request background checks of a psilocybin services applicant. 

 

We are unable to determine the cash receipts as DOH has not determined how many background checks they would request.

 

Assuming electronic submissions, the WSP will charge $34.25 for background checks, of which $13.25 is the FBI fee ($11.25 passed to the FBI and $2.00 retained by the WSP). The balance of the fee ($21.00) is the WSP's fee, leaving total revenue to the Fingerprint Identification Account of $23 ($2 + $21) per background check.
