HB 1440, titled AN ACT Relating to bringing innovation and investment to Washington's economy by streamlining the requirements for deployment of small wireless facilities, has been introduced in the House of Representatives. The Office of Financial Management has identified this bill as requiring a ten-year projection of increased cost to the taxpayers or affected fee payers.

The cash receipts impact to this bill proposal is indeterminate but likely negative as the new prescribed fees in the bill are less than the fees the department currently charges. There is some uncertainty in the bill implementation as it establishes a new small wireless fee structure, but it does not remove the existing language in current law.

 

The prescribed fee structure in section 6 establishes upfront costs of $500 for up to five small wireless sites and $100 for each additional facility for each permit application. A $1,000 fee can be charged for the installation or replacement of a pole of a small wireless facility in the right-of-way. Following that, any annual fee cannot exceed $270 for each facility. Current law requires charging fair market value under leases (not permits). The average annual fee charged today for these types of facilities is $2,500/year. The bill represents a significant decrease vs current law fees– which the bill does not replace or supersede. The exact amount of the cash receipts is uncertain because the department does not know how many new small wireless applications will be received under the new rate structure and law requirements. However, the fee structure under this proposal is lower than current annual fees, so all future annual fee revenue will be less, and revenue losses will result under this proposed law change.
