HB 2052, titled AN ACT Relating to clarifying marijuana product testing by revising provisions concerning marijuana testing laboratory accreditation and establishing a cannabis science task force, has been passed by the Senate Committee on Ways
& Means. The Office of Financial Management has identified this bill as requiring a ten-year projection of increased cost to the taxpayers or affected fee payers.

The proposed legislation has no cash receipt impact for WSDA.
Section 2(4) of the bill would allow Ecology to collect fees from marijuana product testing laboratories in an amount sufficient to cover the direct and indirect costs of implementing a state marijuana product testing laboratory accreditation program beginning July 1, 2022. Fees would be collected in the Dedicated Marijuana Account. Cash receipts from fees are estimated based on current projected costs for implementing the accreditation program, at $362,477 per year beginning in FY 2023 and ongoing. The final amount of the fee and amount per fee payer would be determined after the rulemaking process and any adjustments to Ecology’s projected annual costs for program implementation.
The Department of Health does not collect a fee or revenue; therefore, no fiscal impact to the Department of Health.
The bill grants the Department of Ecology the authority to assess and collect a fee on marijuana product testing laboratories sufficient to cover the direct and indirect costs of implementing a state marijuana product testing laboratory accreditation program.
No cash receipts impact to the Liquor and Cannabis Board.
