SB 5985, titled AN ACT Relating to provisions impacting marijuana business licensees, has been scheduled for a public hearing by the Senate Committee on Labor & Commerce.

The Office of Financial Management has identified this bill as requiring a ten-year projection of increased cost to the taxpayers or affected fee payers.

Ten-year projection:

This bill would allow a "natural person" to hold more than 10% interest in a marijuana license, as long as they possess the same qualifications as the licensee.  If a licensee has a labor peace agreement in effect, a person who is not required to qualify for, or be named on the license is not required to be a resident of this state.  If no labor peace agreement is in effect, all natural persons who own any interest in the entity are required to be a resident of this state.

 

Section 8 of this bill requires that the Board charge an additional $1,000 fee on each "additional" producer, processor, or retailer license allowed under Section 4 of the bill.  The Board does not have an assumption as to how many licenses would fall under this category, so any revenue from these licenses is indeterminate.

 

The Board may charge additional licensing fees to recover additional costs incurred in investigating nonresidents associated with a marijuana license application or renewal, but it is unknown what, if any fees, the Board would charge.
