HB 1048, titled AN ACT Relating to modifying the process for prevailing parties to recover judgments in small claims court, has been passed by the House Committee on Appropriations. The Office of Financial Management has identified this bill as
requiring a ten-year projection of increased cost to the taxpayers or affected fee payers.
Ten-year projection:
There is no cash receipt impact to Labor and Industries (L&I) since it does not file judgments in small claims (district) court. L&I files warrants (liens) in superior court.
This bill would raise the small claims filing fee from fourteen to thirty-four dollars, a twenty dollar increase.
Annual caseloads for small claims filings were reviewed (Caseloads of the Courts of Washington, Courts of Limited Jurisdiction Small Claims Cases – 2017 Report). The number of filings reported for this period was 12,192.
Although some of the fees are waived, there is no data to estimate that number. For purposes of determining revenue impact, it is assumed that the annual increase in revenue would be 12,192 x $20 = $243,840. The revenue is 100 percent local.
The bill does not contain an effective date, so it is assumed the bill would be effective July 1, 2019 (Fiscal Year 2020).
