INDETERMINATE (+) --- It is unclear what the sum of the collection of the per trip or per ride surcharge might be and unknown how section 18(7) might affect the overall collection and distribution of the per trip or per ride surcharge.  

 

Section 18 (1)(a) sets a per trip passenger surcharge fee of ten cents to cover the costs of enforcement and regulation of state Transportation Network Companies (TNC) licensing and to be distributed to local jurisdictions within the state.  Although, section 18 (1)(b) allows for an increase of the per trip passenger surcharge fee 'if independently imposing the fee under subsection (7) of this section'.  In addition, section 18 (3) stipulates that the surcharge fee assessed under section 18 (1) must be remitted directly by the TNC to each city with a population of more than 500,000 or a county with a population of 1 million or more each quarter less the amount necessary to cover the cost to DOL for regulating and permitting TNCs and TNC drivers.  Section 18 (7) enables the imposition and amending an independent per ride fee for local law enforcement costs by local jurisdictions and states that these jurisdictions would be exempt from receiving funds from the TNC Account created in section 22.  "
