What we've been doing
Ecology has been working steadily on the state rulemaking process to amend Chapters 173-18, -20, -22, -26, and -27 under the Shoreline Management Act since we formally announced rulemaking on May 2, 2024. We have been talking with Tribes and Tribal organizations to learn about their concerns and ideas regarding what the new rules should address. We have also held several public listening sessions to solicit feedback on the rules. We recently started holding meetings with local governments to provide input on the rule language. These monthly meetings are open to the public and include a short time for public input at the end. Please see our website for the schedule and a link to join the meetings.
Where we are now
Washington's environmental justice law, the Healthy Environment for All Act, requires us to prepare an environmental justice assessment (EJA) when undertaking a significant agency action such as rulemaking. Therefore, we are preparing to write an EJA, which will provide information on benefits and adverse effects the rule update may have on overburdened communities and vulnerable populations. It will also include measures to minimize any potential harms.
In addition, we are starting to draft language to amend the rules. The existing rule language is extensive, and the amendments include revisions to existing language as well as new content. We are adding requirements for local governments to address the impact of sea level rise and increased storm severity on people, property, and shoreline natural resources and the environment.
What's coming up
Starting in January 2025, we are planning to hold additional public engagement opportunities. We will send out details as soon as we have these scheduled.
In late spring 2025, we expect to have an informal draft of the revised rule language ready for public review.
