What is the scope of the rulemaking?
During this rulemaking, Ecology will consider:
Why are we doing this rulemaking?
Much of the Climate Commitment Act is dedicated to reducing greenhouse gases at the state level. However, measures for reducing overall state levels of greenhouse gases might not decrease another category of pollutants, called “criteria” air pollutants, at the local level. As a result, RCW 70A.65.020 of the Climate Commitment Act directs Ecology to take actions to reduce criteria air pollution in overburdened communities highly impacted by air pollution. This rulemaking will specify processes and procedures that Ecology will follow to implement this section of the law in communities identified as overburdened and highly impacted by air pollution.
Who will these rules affect?
The people of Washington, especially those who live, work, and spend time in the communities identified as overburdened and highly impacted by air pollution.
We have identified 16 areas in Washington that are overburdened and highly impacted by criteria air pollution. The places are a mix of urban, suburban, and rural. They vary in population, from about 1,500 to more than 200,000 people. They also range in area, from less than three square miles to 173 square miles. Together, they represent more than 1.2 million people or about 15.5% of Washington’s population.
In addition, the following may have specific interests in this rulemaking:
- Governor’s Office
- Federal, state and local agencies
- County and municipal governments
- Tribal Nations
- Environmental Justice Council
- Environmental justice community
- Environmental organizations
- Regulated entities
- Non-profit organizations
- Businesses and business organizations
