Rulemaking Notices
Effective May 1, 2025, Developmental Disabilities Administration moved under Home and Community Living Administration. The former Developmental Disabilities Administration is known as Developmental Disabilities Community Service Division within the Home and Community Living Administration.
The following rulemaking notices have been filed with the Office of the Code Reviser and will appear in the Washington State Register.
Proposed Rulemaking (CR-102)
WSR 25-20-052 for Chapter 388-845 WAC
DDCS is enacting these changes to implement changes to DDCS’ home and community-based services (HCBS) waivers as approved by the Centers for Medicare and Medicaid Services (CMS). These amendments clarify waiver service definitions and service limit language across waivers. Amended: WAC 388-845-0113, 388-845-0210, 388-845-0215, 388-845-0220, 388-845-0225, 388-845-0230, 388-845-0820, 388-845-1150, 388-845-1870, 388-845-1880, 388-845-1890, 388-845-2005, 388-845-2205, and 388-845-2210.

Emergency Rule Adoption Order (CR-103E)
WSR 25-20-090 for Chapter 388-845 WAC
DDCS is enacting these changes on an emergency basis to implement changes to DDCS’ home and community-based services (HCBS) waivers as approved by the Centers for Medicare and Medicaid Services (CMS). This emergency filing on these sections is necessary to keep the rules in effect until DDCS completes the permanent rulemaking process. The department filed a CR-101 preproposal under WSR 25-05-034 and a CR-102 under WSR 25-20-052 with a hearing scheduled for November 25, 2025.

Rule Adoption Order (CR-103P)
WSR 25-21-001 on WAC 388-825A-0040
Changes to existing rule 388-825A-0040 to add the effective date of the chapter. The WAC currently states: 388-825A-0040 How does an existing children's residential habilitation services, intensive habilitation services, or enhanced respite services provider obtain certification? (1) For an existing children's residential habilitation services, intensive habilitation services, or enhanced respite services provider who delivered services before [enter effective date of chapter], DDA will issue the provider a special preliminary certification. Remove “[enter effective date of chapter]”and change to “July 1, 2025”.
