Rulemaking Notices
Effective May 1, 2025, Developmental Disabilities Administration moved under Home and Community Living Administration (HCLA). The former Developmental Disabilities Administration is known as Developmental Disabilities Community Service (DDCS) Division within the Home and Community Living Administration.
The following rulemaking notices have been filed with the Office of the Code Reviser and will appear in the Washington State Register.

Emergency Rule Adoption Order (CR-103E)
WSR 25-12-116 for 388-845 WAC
DDCS is enacting these changes on an emergency basis to implement changes to DDCS’ home and community-based services waivers as approved by the Centers for Medicare and Medicaid Services. This is the 2nd emergency filing on these sections and is necessary to keep the rules in effect until DDCS completes the
permanent rulemaking process. The department filed a CR 101 preproposal under WSR 25-05-034.

Emergency Rule Adoption Order (CR-103E)
WSR 25-12-102 for Chapters 388-825, 388-828, 388-842 and 388-845 WAC
DDCS is enacting these changes on an emergency basis to implement home and community-based services (HCBS) waivers as approved by the Centers for Medicare and Medicaid Services (CMS). To read all other CMS-approved waiver amendments effective September 1, 2024, open a waiver under “Current Approved Waivers” on DDCS’s Home and Community-Based Waivers website. This is a subsequent emergency filing on these sections and is necessary to keep the rules in effect until DDCS completes the permanent rulemaking process. DDCS is preparing the rules for external review. We have filed a CR-101 preproposal under WSR 24-18-103. This filing supersedes the emergency filed as WSR 25-05-019.
