The Washington State Department of Revenue is hosting a Listening Session as a follow-up to the Interim Guidance Statement on NFTs:

In anticipation of publishing an Excise Tax Advisory on Non-fungible Tokens, the Washington State Department of Revenue invites you to join us for a Listening Session. The Listening Session is open to the public, and stakeholders are encouraged to attend.

Time: 10:00 A.M.

Location: This meeting will be held virtually by MS Teams.

Purpose and Anticipated Scope

After publishing the Interim Guidance Statement on NFTs, the Department received an outpouring of interest to discuss the guidance statement and requests for topics to be included in future guidance. In the interest of efficiency, we are hoping to bring stakeholders together in one meeting to discuss the interim guidance statement and provide feedback for future permanent guidance.

If you have comments or insight you would like to share on any of the following questions/topics, or on another topic relating to the Interim Guidance Statement on NFTs (IGS), please email us your feedback.

  • What would be helpful for us to include in terms of content or examples in future permanent guidance?
  • Is there anything in the IGS that we should consider correcting or clarifying?
  • Are there certain types of NFTs (or aspects thereof) that are not currently covered in the IGS that should be?
  • What are issues that you are encountering in your practice that you want us to know about so we can provide guidance on?
  • Are there issues regarding sourcing or resale that would be helpful to have guidance on?
    • Current issues we have already identified from external stakeholder feedback received to date: sourcing and blind forms of payment, tangible personal property, and reseller issues.
  • Tax treatment of NFT transactions completed prior to July 1, 2022.
