Due Tuesday 10/14: Comments on Medical Cannabis Standards Rulemaking (Chapter WAC 246-70)
We are close to having a complete rule draft that updates medical cannabis standards, including terminology, classifications of medical product, quality assurance testing, and labeling/logos. The current draft considers all feedback we have received and discussed in public workshops over the past year.

New language
We would like to call your attention to new language that was not presented and discussed during the public workshops. These additions are based on stakeholder recommendations:
- A more protective action level for benzene. See WAC 246-70-050(2)(b) on page 20.
- A more protective action level for bile- tolerant gram- negative bacteria. See WAC 246-70-050(2)(b) on page 20.
We also encourage comments on the entire proposed rule.
Next Steps
The next step will be preparing for the 102 which will include a public hearing and opens the formal public comment period. You will also be able to provide comments before and during the hearing.
We will send a notice with the final draft and hearing date as soon as it is available.
About this Rulemaking
The goal of this rulemaking is to:
- Align quality assurance and control standards with recent WA State Liquor and Cannabis Board rule changes.
- Consider updated terminology and requirements for products compliant for medical use, including product categories
- Evaluate quality assurance testing requirements.
- Consider changes to compliant product labeling and logos.
- Address statutory tax exemptions for recognition cardholders.
- Replace the term "marijuana" with "cannabis" in accordance with Second Substitute House Bill 1210 passed in 2022.
