Notice of Emergency Rulemaking for the Home Care Aide program.
Purpose:
Under Senate Bill 5672, passed during the 2025 legislative session, the Department of Health (department) will adopt emergency rules to allow long-term care workers additional time to become certified. Currently, the certification deadline is calculated 200-days after the date of hire, after which the caregiver must cease practice until certified, potentially leaving clients at risk of limited to no caregiver available to provide the services they need in their daily lives. Caregivers often struggle to become certified due to demanding workload, limited availability, training obligations, and difficulties with scheduling and testing, which frequently result in a lapsed 200-day certification timeline.
To help continue reducing barriers for the workforce, SB 5672 permits the department to set a new certification deadline. This proposed emergency rule update offers caregivers greater flexibility to balance their work and personal schedules, giving them additional time to complete the certification process, while continuing to provide care to their clients.
