About the Rulemaking
On November 2, 2022, The Washington Department of Health (department) filed a CR-101 Preproposal Statement of Inquiry to consider rulemaking to:
- Align quality assurance and control standards with recent WA State Liquor and Cannabis Board rule changes.
- Consider updated terminology and requirements for products compliant for medical use, including product categories and quality assurance testing.
- Consider changes to compliant product labeling and logos.
- Address statutory sales and use tax exemptions for recognition cardholders.
- Replace the term "marijuana" with "cannabis" in accordance with Second Substitute House Bill 1210 passed in 2022.
Approach for the Second Workshop
Since the 1st workshop, held last September, our team has evaluated feedback from the workshop, discussed policy options, and drafted language for Definitions under WAC 246-70-030 and Product Categories (general, high-CBD, high-THC) under WAC 246-70-040. We are finalizing draft language and compiling an overview of proposed changes and questions we want to ask you.
1-2 weeks prior, we will send materials for the workshop. You will have an opportunity to share input in writing as well as during the workshop.
We will also discuss steps for the 3rd workshop, during which we hope to cover Quality Assurance Testing, Labeling, and Logos (WAC 246-70-050, -060 and -090).
Please let me know if you have questions. Thank you!
