Topic: Proposal (CR-102) – Requirements of decertified employer groups and municipalities

Brief Description: The purpose of this rulemaking is to update WAC 296-15-121, WAC 296-15-123, WAC 296-15-151 and establish WAC 296-15-184. These changes will ensure funds are available to benefit injured workers should their self-insured employer be decertified. This will include rules regarding the continued obligations of decertified self-insured employers, and how self-insured employers shall meet their financial obligations. The proposed rules will implement House Bill 1275 (HB1275), Chapter 57, Laws of 2025, which ensures that decertified self-insurers remain liable for their self-insured claims and reimburse the Department of Labor & Industries for payments made.

Making these changes will bring the rules into alignment and comply with RCW 51.14.500 – Certain decertified self-insurers – Compensation obligations – Reimbursement.
