L&I updates rules to expand worker access to personnel files
The Washington State Department of Labor & Industries (L&I) Employment Standards Program updated WAC 296-126-050 related to personnel files (formerly titled employment records). The adopted change aligns the section in rule with recent changes to Chapter 49.12 RCW in Substitute House Bill 1308 (SHB 1308), Chapter 273, Law of 2025.
Under the law, employers have 21 calendar days to give employees access to their own personnel files after a request. The updated rule also clarifies what records may be included in a personnel file and allows employees and former employees to take legal action if those access rules are violated.
Rule effective date: May 1, 2026
