Self-Insurance Good Faith and Fair Dealing rules adoption date now May 21, 2024

Washington State Department of Labor & Industries (L&I) is moving the proposed CR-103 filing date for adoption of the Self-Insurance Good Faith and Fair Dealing rules to May 21, 2024, from April 30, 2024.

The change will not affect the rules’ expected effective date, which remains July 1, 2024. The filing date change will allow more time to review public comments on the proposed rules.

The CR-103 filing is the final step in the rule adoption process to create or amend sections to the Washington Administrative Code (WAC).

L&I has been engaged in ongoing work to support legislation that requires some self-insured employers and their third-party administrators to practice good faith and fair dealings with their injured workers.

Proposed rules to implement the legislation were filed on Feb. 20, 2024, and a public hearing was held March 29, 2024. You can find more details about these rules, including the proposed rule language, on L&I’s rulemaking page.
