L&I releases rules as part of new law requiring paid sick leave payouts to certain construction workers

Beginning Jan. 1, Engrossed Substitute Senate Bill 5111 (ESSB 5111) requires employers to provide certain construction workers with a payout of unused paid sick leave following separation. This does not apply to those who perform only residential construction. This new requirement will be enforced by L&I.

L&I’s Employment Standards Program has released rules to enforce the new law, provide clarification on existing paid sick leave requirements for construction workers, and provide general cleanup of existing paid sick leave rules. The rules and requirements are also effective Jan. 1.

The “Changes to the Paid Sick Leave Requirements for the Construction Industry” webinar will be a 60-minute presentation by the paid sick leave specialist from L&I’s Employment Standards Program, and includes the opportunity to ask questions.

The “Paid Sick Leave Overview” webinar includes information on rule updates and existing regulations for Paid Sick Leave, including PTO programs, notifications, frontloading, and more.

The schedule is:

  • Dec. 19 at 10:30 a.m.
  • Jan. 23 at 1:30 p.m.
  • Feb. 27 at 10 a.m.
  • March 26 at 1:30 p.m.
