Topic: Proposal Continuance (CR-102) - Factory Assembled Structures (FAS) Fee Increase
Brief Description: Due to technical difficulties at the originally scheduled hearing on January 27, 2021, which prevented public and committee member attendance, L&I filed a continuance of the proposal to reschedule the public hearing date and to extend the written comment period.
The purpose of this rulemaking is to propose changes to the Factory Assembled Structures (FAS) rules to increase fees by 5.91%. The fee increase is the maximum allowed by the state Office of Financial Management for fiscal year 2021. The budget and projected revenue of the FAS program was evaluated and a fee increase is needed to support the cost of ongoing services. A fee increase will enable the program to continue providing quality and timely services to assure the health and safety of Washington State citizens who work and live in factory-built housing and commercial structures.
Proposed fee increase for the following FAS rules:
- WAC 296-150C-3000, Commercial coach fees;
- WAC 296-150F-3000, Factory-built housing and commercial structure fees;
- WAC 296-150I-3000, Penalties, fees, and refunds (Manufactured Home Installer Training and Certification Program);
- WAC 296-150M-3000, Manufactured/mobile home fees;
- WAC 296-150P-3000, Recreational park trailer fees;
- WAC 296-150T-3000, Factory-built temporary worker housing fees; and
- WAC 296-150V-3000, Conversion vendor units and medical units – Fees.

Topic: Proposal (CR-102) - Demolition Standards
Brief Description: The purpose of this proposal is to update the requirements in chapter 296-155 WAC, Safety standards for construction work, Part S, Demolition. This rulemaking will remove confusing and unnecessary language, add clarification where necessary throughout the rule to improve employee and public safety, and make other updates and housekeeping changes where needed. Following an investigation of demolition violations related to the Highway 410 overpass collapse and a subsequent review of the citation history for the demolition requirements under chapter 296-155 WAC, Part S, L&I determined that rule changes are needed to ensure that demolition plans are developed and implemented.
While the current rule requires a demolition survey with a demolition plan be conducted prior to starting demolition, neither DOSH’s rule nor the Occupational Safety and Health Administration (OSHA) explicitly require the employer to follow the demolition plan it developed or the safety recommendations contained in the survey. Based on a review of past inspections, including Highway 410 overpass collapse inspection, it was determined that without a clear requirement to require a demolition plan that is based on the engineering survey information, more incidents exposing workers and the public are likely to occur.
If demolition is not conducted according to a plan consistent with the engineering survey, hazards such as unplanned collapses and hazards from flying or dropping debris, can injure both workers and the public. The proposed rule requires a demolition plan be developed specific to a particular demolition project and in consideration of the engineering survey for the specific project and that the plan be implemented.

Topic: Adoption (CR-103) – DOSH eRules Phase XII (12)
Brief Description: This adoption amends chapter 296-307 WAC, Safety standards for agriculture, Parts A, I and O. This rulemaking is part of the DOSH eRules project. It provides consistency in formatting, design and accessibility to the rules via mobile electronic devices, and does not add or change any requirements.
This rulemaking accomplishes the following:
- Consistent format for all DOSH rules;
- Easy to access rules for smart phone and tablet users;
- Easy navigation in PDF files provided through bookmarks in the rules;
- Easier referencing by replacing bullets and dashes with numbers and letters; and
- Enhanced rule update efficiency for customers through electronic postings.
