Washington Administrative Code (WAC) Updates
History The Licensing Division (LD) of DCYF proposed WAC changes in support of WA CAP implementation. Early in the WA CAP project, we identified the need to research existing WACs and either revise or create new WACs in chapters 110-145, 110-147, and 110-148 before LD implemented the WA CAP online provider portal. These changes were needed to ensure alignment between practices and technology and provide long-term stability.
Work Groups DCYF staff and external stakeholders formed nine task force groups. After several months, the task force groups presented proposed business practice changes. Any business practice approved for change at that time also required a review of the following:
- Website
- Forms
- Policy
- Exception to Policy
- WAC
This review ensured alignment between the new practices and other agency resources.
Changes to WAC are necessary to align the work with legal requirements. LD posted all proposed WAC changes for public comment early in 2022, as required by law; the final rules took effect on June 18, 2022.
What Are Some of the Changes?
- WAC now requires the use of a licensing provider portal (WA CAP) when available
- Submission of negative TB test, proof of pertussis, and influenza immunizations through the
portal
- A timeline of 90 days for submission of an application through the portal
- Clarification of language to ensure that applicants will not submit child or children's
information in the portal
- Updates related to non-discrimination; definitions and protections for LGBTQIA+ children and
youth were refined
- Case plan was defined
- Caregiver orientation was removed as a requirement for licensing
- In-person CPR cannot be waived
- Grammatical fixes and naming changes (e.g., DCYF instead of Children's Administration)

When Did the WAC Changes Go Into Effect?
These WAC updates were implemented on June 18, 2022.
The use of WA CAP to meet the requirement of a licensing provider portal will be implemented for different groups at different times. For example, Child Placing Agencies will only be required to use WA CAP once their agency goes live. More information, including rollout schedules for agencies and facilities, will be provided as the project continues to evolve.
