Stormwater Management Updates

A reminder for all builders, design professionals, and property owners about the requirement to submit an LDA plan revision before adding new impervious surfaces and/or making grading changes after the closeout of an LDA project.

This requirement preserves the intent of the LDA program to mitigate stormwater impacts for the life of a project.  It took effect with Stormwater Facility Maintenance and Monitoring Agreements (MMA) recorded starting in September 2021. 

 

The MMA applies to all current and future property owners. 

 

Specifically, Section 12 of the MMA states:

  1. The Landowner, its successors and assigns, shall submit an LDA Plan revision if either of the following circumstances occur:
  • New impervious surfaces are added that are not shown on the Plans and where the impervious surface increase is the lesser of 10% of the impervious area treated as shown on the Plans or 300 square feet of impervious area; or
  • Changes to the Property grading and drainage (as approved with the as-built grading plan) occur that cause adverse impacts to adjacent properties and/or alter the drainage area associated with any Facility.

 

Please consider this requirement as you plan and design your LDA project.  It is generally much more difficult to mitigate new stormwater impacts after the primary project construction is completed.  Requirements for submitting a plan revision may be found by emailing stormwaterreivew@arlingtonva.us .

 

Please understand that if you fail to submit the LDA plan revision before adding new impervious surfaces and/or making grading changes, the County may exercise any enforcement mechanisms available to it.  These may include placing a lien on the property to collect costs incurred by the County, an action at law to recover any damages incurred by the County, or an action in equity to effect compliance with the terms of the MMA.
