During our last Veterans Service Organizations (VSOs) call, Education Service received a request to clarify if there had been any changes made to the 85/15 Rule and the 35% Exemption.
A Federal Register notice (Agency Information Collection Activity Under OMB Review: 35% Exemption Request From 85/15 Reporting Requirement) concerning this topic was post on November 22, 2024. This notice is an announcement that Education Service will be submitting a notice to the Office of Management and Budget to initiate the 30-day notice and comment period required every three years under the Paperwork Reduction Act. This 30-day notice corrects the notes in the 35% Exemption instructions to make clear that only non-accredited facilities must continue to comply with the provisions of the 85/15 Rule during the periods when a 35% exemption is in place.
