VA has proposed a rule to implement a provision of the Veterans Benefits and Transition Act (Act) of 2018 (Public Law 115-407, Title I, Section 103). The rulemaking (and parallel statute) requires the State Approving Agency (SAA), or Secretary of VA, when acting as an SAA, to disapprove programs of education that do not permit individuals using benefits under chapter 31 or chapter 33 of title 38, United States Code, to attend or participate in courses while awaiting payment from VA for up to 90 days after the date of certification of tuition and fee charges. Therefore, it’s highly advantageous to veteran students because it prevents any lapses in their program participation due to a potential VA payment delay.
The public comment period will be from February 27, 2023, until April 27, 2023.
