You are receiving this communication because the United States Department of Veterans Affairs’ (VA) records indicate that one or more of your facility’s programs of education is presently approved for participation in VA educational assistance programs.
This correspondence contains important information about recent changes made by the enactment of the “Responsible Education Mitigating Options and Technical Extensions Act” or the “REMOTE Act” of 2021 to Section 1018 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (Public Law 116-315).
What is section 1018 and 38 U.S.C. § 3679(f)?
Section 1018, establishing 38 U.S.C. § 3679(f), requires educational institutions to provide students with certain financial information and other requirements. VA provided an overview of the requirements of section 3679(f) in an email dated July 13, 2021 (here). Schools must comply with the requirements to qualify for GI Bill funds. The REMOTE Act delayed the effective date of this section until 2022. This section goes into effect on June 15, 2022 and applies to educational institutions beginning August 1, 2022.
The REMOTE Act affords the opportunity for schools to use the College Financing Plan (CFP), available through the Department of Education as a means to satisfy the requirements of section 3679(f). An Educational Training Institution that utilizes this form is providing sufficient consumer information, will be exempt from all section 3679(f) requirements, and does not need to apply for a waiver. An Educational Training Institution does not need to be participating in title IV Federal Student Aid to utilize the CFP to satisfy the requirements of section 3679(f).
