ABLA Civil Penalty Adjusted for Inflation
On Thursday, January 16, 2025, we published the latest civil monetary penalty inflation adjustment notification, adjusting the maximum penalty for violations of the Alcoholic Beverage Labeling Act of 1988 (ABLA). Beginning January 16, 2025, the maximum penalty for violations of the ABLA is raised from $25,561.00 to $26,225.00, with each day constituting a separate offense. TTB makes this penalty adjustment annually as required by the Federal Civil Penalties Inflation Adjustment Act of 1990, as amended.
In general, the ABLA requires a government health warning statement on all alcohol beverage containers sold or distributed in the United States, as well as on such containers sold or distributed to the U.S. Armed Forces, including those stationed overseas.

 We have accepted offers in compromise from Dark Storm Industries LLC for failing to file excise tax returns and pay tax, and Comstock Distillers LLC for filing returns and paying on a monthly basis instead of semi-monthly.

SUMMARY: The subject investigation was requested in petitions filed on December 29, 2023, by the U.S. Glass Producers Coalition, which is comprised of Ardagh Glass Inc., Indianapolis, Indiana and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, Pittsburgh, Pennsylvania. On December 10, 2024, counsel for the petitioner filed with the Department of Commerce a request to withdraw its petition regarding imports of glass wine bottles from Chile. On December 30, 2024, the Department of Commerce published notice in the Federal Register of the termination of its subject investigation concerning glass wine bottles from Chile (89 FR 106425). Accordingly, the antidumping duty investigation concerning glass wine bottles from Chile (Investigation No. 731–TA–1661 (Final)) is terminated.

ACTION: Notice of proposed rulemaking
SUMMARY: This document proposes a new regulation pursuant to the Trade Act of 2002 requiring the submission of export manifest data electronically to U.S. Customs and Border Protection (CBP) in the Automated Commercial Environment (ACE) for cargo transported by rail for any train departing the United States. The proposed regulation would mandate the electronic transmission of rail export manifest information, identify the parties eligible to transmit information, and describe the time frames prior to departure of the train in which the information is due. This rule would enable CBP to address important cargo security concerns while providing efficiencies to the trade.
