CBMA Spotlight Series: Comment Period Closing for Temporary Regulations to Implement CBMA Import Refund
The Craft Beverage Modernization Act (CBMA) provisions of the Internal Revenue Code (IRC) provide for reduced rates or tax credits for certain quantities of beer, wine, and distilled spirits produced in or imported into the United States. A recent change in the law transferred responsibility for administering the CBMA tax benefits for imported alcohol from U.S. Customs and Border Protection (CBP) to TTB beginning with products entered for consumption in the United States on or after January 1, 2023.
On September 23, 2022, we published a temporary rule implementing these provisions and providing procedures for foreign producers and importers, as well as a notice of proposed rulemaking to obtain comments on the provisions in the temporary rule and on an additional proposed regulatory amendment.
Comments on that notice are due by November 22, 2022.

Reminder: Foreign producers should register now using the myTTB system (see our user guide for help). Registration will be necessary to make assignments to importers for calendar year 2023.

SUMMARY: The Federal Trade Commission (the ‘‘Commission’’) proposes to commence a rulemaking proceeding to address certain deceptive or unfair uses of reviews and endorsements. The Commission is soliciting written comment, data, and arguments concerning the need for such a rulemaking to prevent unfair or deceptive marketing utilizing reviews and endorsements. In addition, the Commission solicits comment on how the Commission can ensure the broadest participation by affected interests in the rulemaking process.
