At the January public meeting, Commissioners published proposed amendments to the federal sentencing guidelines for the amendment year ending May 1, 2023. The Commission is seeking public comment on these proposed amendments with a comment period ending March 14, 2023. As part of the proposed amendments, the Commission is considering a proposed amendment related to criminal history and the Commission’s implementation of 28 U.S.C. § 994(j). In order to inform comment on the proposed criminal history amendment, the Commission has released a data briefing presenting data on following aspects of criminal history, which are relevant to the three-part proposed amendment:

  • status points;
  • offenders with zero criminal history points; and,
  • simple possession of marijuana offenses.
