USPTO waives the petition fee for the Artificial Intelligence Search Automated Pilot Program (ASAP!)
In order to alleviate any financial barriers to participate in the Artificial Intelligence Search Automated Pilot Program (ASAP!) program, the United States Patent and Trademark Office (USPTO) is sua sponte waiving the petition fee set forth in 37 CFR 1.17(f) for petitions filed under 37 CFR 1.182 to participate in program. This applies to any petition under 37 CFR 1.182 to participate in the program using Form PTO/SB/470 filed on or after March 23, 2026.
In addition, the USPTO is increasing the number of applications that will be accepted into the program. The USPTO now plans to accept at least 3,200 patent applications distributed across the Technology Centers (TCs) that examine utility applications, including at least 400 applications per TC that examines utility applications. The USPTO will accept petitions to participate in the program until either April 20, 2026, or the date that each TC that examines utility applications has docketed at least 400 applications accepted into this program, whichever occurs first.
