Director Orders Reexamination of U.S. Patent No. 12,430,397 B2
On November 3, 2025, the Director ordered reexamination of U.S. Patent No. 12,430,397 B2, which relates to video game technology. Pursuant to 35 U.S.C. § 304 and 37 C.F.R. § 1.520, the Director may determine whether reexamination is warranted in the first instance. Here, the Director determined that substantial new questions of patentability were raised by prior art references called Yabe and Taura, which were not previously made of record during prosecution. Reexamination at the Director’s initiative is distinct from, and not a substitute for, third-party requests for reexamination under 37 C.F.R. § 1.510. If a member of the public desires reexamination of a patent, a request and fee under 37 C.F.R. § 1.20(c)(1) or (c)(2) should be filed in accordance with 37 C.F.R. § 1.510. See MPEP § 2239.
