In this decision, the Director vacated and remanded a Board decision granting institution where the petitioner proposed different claim construction positions before a district court and the PTAB. The decision clarifies that simply accepting a patent owner’s proposed claim constructions from a parallel litigation is not a sufficient reason for advancing different positions between the two forums.
